HomeMy WebLinkAbout11892I RESOLUTION NO. 11,892 3 A RESOLUTION TO EXTEND THE 120 -DAY MORATORIUM ESTABLISHED IN 4 LITTLE ROCK, ARK., RESOLUTION NO. 11,824 (SEPTEMBER 14, 2004) 5 FOR A PERIOD NOT TO EXCEED THIRTY (30) DAYS WHILE THE BOARD OF 6 DIRECTORS CONSIDERS A NEW DECLARATION OF SCENIC CORRIDORS; 7 AND FOR OTHER PURPOSES. 8 9 WHEREAS, the Little Rock Planning Commission has completed consideration of whether 10 to declare four (4) areas of the City as a scenic corridor and its recommendations will be 11 presented to the Little Rock Board of Directors on January 18, 2005, and 12 WHEREAS, Little Rock, Ark., Res. No. 11,824 (September 14, 2004) established a one 13 hundred and twenty day (120) moratorium on the erection of billboards in these four areas 14 which is presently set to expire on January 12, 2005, and 15 WHEREAS, the Board of Directors does not want the moratorium to expire pending final 16 action on these recommendations, 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF 18 LITTLE ROCK, ARKANSAS: 19 Section 1. The moratorium established in Little Rock, Ark., Resolution No. 11,824 20 (September 14, 2004), is hereby extended for a period not to exceed thirty (30) days from 21 the date of adoption of this resolution. 22 Section 2. If final action by the Board of Directors on the recommendations for the 23 creation of new scenic corridors occurs prior to the thirty (30) day extension set forth in this 24 resolution, then this moratorium shall end upon the occurrence of such action. 25 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, 26 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, 27 such declaration or adjudication shall not affect the remaining portions of the resolution 28 which shall remain in full force and effect as if the portion so declared or adjudged invalid or 29 unconstitutional were not originally a part of the resolution. Repealer. All ordinances and resolutions, inconsistent with this resolution, including but not limited to certain provisions of Little Rock, Ark., Resolution No. 11,824 (September 14, 2004), are hereby repealed to the extent of such inconsistency.
