HomeMy WebLinkAbout13859 1 RESOLUTION NO. 13,859 2 3 A RESOLUITION TO APPOINT SPECIAL COMMISSIONERS FOR THE 4 DISSOLUTION OF WATER AND SEWER IMPROVEMENT DISTRICT 5 NO. 141 OF LITTLE ROCK,ARKANSAS; AND FOR OTHER PURPOSES. • 6 7 WHEREAS, the City of Little Rock created Water and Sewer Improvement District No. 141 8 pursuant to Little Rock, Ark.,Ordinance No. 15,504(June 29, 1988)to construct water lines and a sanitary 9 sewage connector in developing areas of Bowman and Kanis Roads; and, 10 WHEREAS, the construction has been completed,the lines have been conveyed to the appropriate 11 utilities,and there is no reason to maintain the operation of the District; and, 12 WHEREAS,the last levied assessment of the District was in 2007 and there is no reason to maintain 13 the District; however, it has been virtually impossible to get property owners within the District to serve as 14 Commissioners for the purpose of dissolution,and the former Commissioners are no longer property owners 15 within the District; and, 16 WHEREAS,pursuant to Ark.Code Ann. § 14-88-303 (West Supp.2014)it is appropriate to appoint 17 new Commissioners to protect with dissolution; 18 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK,ARKANSAS: 20 Section 1. The Board appoints Mark Spradley, Alan King, and Marian Walker as Commissioners 21 of Water and Sewer Improvement of Water and Sewer Improvement District No. 141 of Little Rock, 22 Arkansas. 23 Section 2. These appointments are made under special circumstances to cause the distribution of 24 excess funds to the District property owners and otherwise pursuant to law, to prepare a final financial 25 report,to dissolve the District,and to perform any other lawful acts, necessary and proper,to complete this 26 dissolution in a timely manner. 27 Section 3. These appointments are subject to the persons named in Section completing and filing 28 their Oath of Office by no later than May 15, 2014. 29 Section 3. Severability. In the event any title, section, paragraph, item, sentence,clause, phrase,or 30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 32 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 33 resolution.
