8 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide
9 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use off'==°
10 various City and Federal Funds, and in affirmative actions such as the creation of a Land Bank;{„,;++P+++
11 Commission; and,
12 WHEREAS, in order to accomplish this goal the City's Land Bank has acquired numerous properties
13 in areas that are appropriate for revitalization; and,
14 WHEREAS, in an effort to maximize the City's revitalization efforts, the Land Bank Commission
15 wishes to convey underutilized, vacant, and unimproved parcels to neighboring property owners pursuant
16 to the Land Bank Side Lot Program; and,
17 WHEREAS, on December 27, 2005, the City of Little Rock acquired numerous unimproved lots in
18 the Rolling Pines Subdivision; and,
19 WHEREAS, in February 2014, the Land Bank Commission completed the Final Plat of the Rolling
20 Pines Subdivision, resulting in eighty-one(81)City-owned lots; and,
21 WHEREAS, Mr. Billy Thomas Hayes, the homeowner who resides on Lot 77 of the Rolling Pines
22 Subdivision, has submitted an application under the Land Bank Side Lot Program and has indicated a
23 desire to acquire Lot 78 of the Rolling Pines Subdivision for the stated purpose of clearing, landscaping
24 and expanding his yard; and,
25 WHEREAS, Lot 78 of the Rolling Pines Subdivision is a 7,000 square-foot unimproved lot that is
26 contiguous to Lot 77 on its eastern boundary and contiguous to a wooded area on its western boundary,
27 see Exhibit A attached; and,
28 WHEREAS, Mr. Hayes has made an offer to purchase the lot for Five Hundred Dollars ($500.00)
29 pursuant to the Land Bank Side Lot Program guidelines; and,
30 WHEREAS, any transfer under the Land Bank Side Lot Program will include a deed restriction
31 limiting the use of the property to the stated use in the application; and,
32 WHEREAS, the Land Bank Commission reviewed the application and voted in favor of the transfer
33 of Lot 78 of the Rolling Pines Subdivision to Mr. Hayes for the purpose stated therein; and,
34 WHEREAS, State Law requires that the City convey property by resolution adopted by the Board of
35 Directors;
1 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
2 OF LITTLE ROCK,ARKANSAS:
3 Section 1.The Board of Directors hereby adopts this resolution to authorize the Land Bank to transfer
4 to Mr. Billy Thomas Hayes by Special Warranty Deed the property located at Lot 78 of the Rolling Pines
5 Subdivision under the Land Bank Side Lot Program.
6 Section 2. The property shall be used for the public purpose of conveying underutilized properties.
7 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
8 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
9 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
10 effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
11 ordinance.
12 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
13 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
