HomeMy WebLinkAbout13821 1 RESOLUTION NO. 13,821 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY CLERK AND 4 CITY MANAGER TO EXECUTE ANY DOCUMENTS NEEDED FOR THE 5 CITY TO LEASE CERTAIN PROPERTY LOCATED AT 3719 6 BATESVILLE PIKE, NORTH LITTLE ROCK, ARKANSAS, FOR 7 EMERGENCY COMMUNICATIONS PURPOSES; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, the City is proceeding to make needed improvements to its Emergency Radio 11 Communications System, and 12 WHEREAS, as a part of the City's communications infrastructure improvements, the existing 13 radio communications tower at 3719 Batesville Pike in North Little Rock, Arkansas, will be a significant 14 component of such improvements as its use will increase the City's radio transmission range, and 15 WHEREAS, Pulaski County currently has a lease agreement for the Batesville Pike tower site with 16 the site's owner, Ron Gangluff,and the City wishes to also utilize the Batesville Pike tower site for its own 17 equipment with Pulaski County's concurrence,and Mr.Gangluff agrees to allow the City as well as Pulaski 18 County to use the tower site. 19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 20 CITY OF LITTLE ROCK,ARKANSAS: 21 Section 1. The Mayor, City Clerk and City Manager are hereby authorized to execute any 22 documents needed for the City to lease certain communications tower site property located at 3719 23 Batesville Pike, North Little Rock, Arkansas from owner Ron Gangluff for the City's emergency 24 communications purposes, for the amount and the period of time stated in Section 2 below, as negotiated 25 by the parties and with any approval needed by Pulaski County, in a form approved by the City Attorney. 26 Section 2. For leasing the Batesville Pike communications tower site, the City shall pay to Ron 27 Gangluff the negotiated amount of$10,000 for 2013, with annual rent payable each year thereafter during 28 the period of the lease. Beginning in 2014, the rent amount shall be Ten Thousand Dollars ($10,000.00) 29 plus the lesser of 3% of the previous year's rent or an amount equal to the increase in the Consumer Price 30 Index. The Consumer Price Index shall mean the Consumer Price Index for all urban consumers, all cities, 31 and all items. The timing of the City's lease payments shall be the same as those existing in the current 32 lease of the Batesville Pike communications tower site between Pulaski County and Ron Gangluff. The 33 lease period shall terminate on March 25, 2021, which is co-extensive with the lease by Pulaski County of [Page 1 of 21 1 the Batesville Pike tower property. 2 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 3 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 4 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 5 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 6 resolution. 7 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 8 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 9 ADOPTED: December 17,2013 10 ATTES .
