3 AN ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT
4 AND ESTABLISH A PLANNED COMMERCIAL DISTRICT TITLED
5 MACARTHUR COMMONS SHORT-FORM PCD (Z-1718-A), LOCATED
6 IN THE 400 BLOCK OF EAST CAPITOL AVENUE, BETWEEN RIVER
7 MARKET AVENUE AND ROCK STREET, LITTLE ROCK, ARKANSAS,
8 AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE
9 ROCK,ARKANSAS; AND FOR OTHER PURPOSES.

11 BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
12 ARKANSAS.
13 SECTION 1. That the zoning classification of the following described property be changed from
14 UU,Urban Use District,to PCD,Planned Commercial District:
15 A tract of land being a part of Block 149,Original City of Little Rock,Arkansas,and
16 a part of Block 17, Pope's Addition to the City of Little Rock,Arkansas, and a part
17 of a strip of land which was formerly platted as an alley which lies between said Block
18 149, Original City of Little Rock, Arkansas, and said Block 17, Pope's Addition
19 Pulaski County, Arkansas, also being a part of Section 2, Township 1 North,Range
20 12 West, Pulaski County, Arkansas, being more particularly described as follows:
21 Beginning at a Melburgher No.3 Monument,being the southwest corner of Block 140
22 Original City of Little Rock,Arkansas, run thence along the east right-of-way line of
23 Rock Street (sixty (60)-foot right-of-way) 147.25 feet to a point; thence leaving said
24 right-of-way line, S80°35'49"E,212.03 feet to a point; thence S09°24'19"W 8.00 feet
25 to a point; thence S80°35'49"E 86.83 feet to a point on the west right-of-way line of
26 River Market Avenue (sixty (60)-foot right-of-way); thence along said right-of-way
27 line S09°24'19"W, 139.25 feet to a set chiseled scribed "X" in concrete on the north
28 right-of-way line of East Capitol Street(eighty(80)-foot right-of-way),said point also
29 being the southeast corner of Block 17,Pope's Addition; thence along said right-of-
30 way line, N80°35'49"W, 300.86 feet back to the point of beginning said tract ,,ol."

1 SECTION 2. That the preliminary site development plan/plat be approved as recommended by
2 the Little Rock Planning Commission.
3 SECTION 3. That the change in zoning classification contemplated for MacArthur Commons
4 Short-Form PCD (Z-1718-A), located in the 400 Block of East Capitol Avenue, between River Market
5 Avenue and Rock Street, is conditioned upon obtaining a final plan approval within the time specified by
6 Chapter 36,Article VII, Section 36-454 (e)of the Code of Ordinances.
7 SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of
8 Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the
9 respects necessary to affect and designate the change provided for in Section 1 hereof.
10 SECTION 5. That this ordinance shall not take effect and be in full force until the final approval
11 of the plan.
12 SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause,
13 phrase,or word of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration
14 or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
15 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
16 ordinance.
17 SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are
18 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
