ORDINANCE NO. 19,431
3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A CONTRACT WITH SBC FOR THE UPGRADE OF THE
6 EXISTING TELPHONE NETWORK; AND FOR OTHER PURPOSES.

8 WHEREAS, in 2003, voters in the City of Little Rock approved a city capital
9 improvement bond issue which included $1 million to allow for the implementation of
10 a 3 -1 -1 General Information Telephone System that will centralize access to City of Little
11 Rock services and divert non - emergency and other administrative inquiries from the 9-
12 1 -1 system, and
13 WHEREAS, in order to implement a fully integrated 3 -1 -1 system complete with
14 automatic number, location identification and integrated voice response , it will be
15 necessary to upgrade the existing telephone network, and
16 WHEREAS, a quote has been received from SBC to provide the telephone
17 networking equipment and service for the 3 -1 -1, 9 -1 -1 and local telephone system, in the
18 amount of Three Hundred Sixty -six Thousand, Nine Hundred Seventy -one and 76/100
19 Dollars ($366,971.76), including all applicable taxes, and
20 WHEREAS, competitive bidding should be waived and the contract for such
21 equipment awarded to SBC as the sole source provider of our 9 -1 -1 emergency
22 telephone system and the only vendor capable of providing the complete telephone
23 networking equipment and service for the 3 -1 -1, 9 -1 -1 and local telephone system.
24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
25 OF THE CITY OF LITTLE ROCK, ARKANSAS:
26 Section 1. The Board of Directors finds that competitive bidding should be
27 dispensed with in the upgrading of the existing telephone network for the 3 -1 -1 in order
28 to ensure the proper integration of the 3 -1 -1 system with our existing telephone

I network and the 9 -1 -1 Emergency System, as an exceptional situation exists and
2 competitive bidding is impractical and infeasible.
3 Section 2. The City Manager is hereby authorized to dispense with competitive
4 bidding and to enter into a contract with SBC to provide the telephone networking
5 equipment and service for the 3 -1 -1, 9 -1 -1 and local telephone system, in the amount of
6 Three Hundred Sixty -six Thousand, Nine Hundred Seventy -one and 76/100 Dollars
7 ($366,971.76), including all applicable taxes, and
8 Section 3. Funds for this purchase are available from the 2004 Bond Project.
9 Section 4. Severability. In the event any title, section, paragraph, item, sentence,
10 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
11 unconstitutional, such declaration or adjudication shall not affect the remaining
12 portions of the ordinance which shall remain in full force and effect as if the portion so
13 declared or adjudged invalid or unconstitutional was not originally a part of the
14 ordinance.
15 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are
16 in conflict with any provision of this ordinance are hereby repealed to the extent of such
17 conflict.
