PULASKI COUNTY CIRCUIT/COUNTY CLERK 1 ORDINANCE NO. 20,788 Fees$20.00 2 3 AN ORDINANCE TO CONDEMN A CERTAIN STRUCTURE IN THE 4 CITY OF LITTLE ROCK, ARKANSAS, AS A STRUCTURAL, FIRE AND i �E C I R /j 5 HEALTH HAZARD; TO PROVIDE FOR SUMMARY ABATEMENT ./8( •- �a 6 PROCEDURES; TO DIRECT THE CITY MANAGER TO TAKE SUCW W �•°'` ' > 7 ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID s� ' Q 8 STRUCTURE; TO DECLARE AN EMERGENCY; AND FOR OTHER 'a'ti c:4",ss‘ 9 PURPOSES. 10 11 WHEREAS, a certain structure in the City of Little Rock, Arkansas, has become rundown, 12 dilapidated, unsightly, dangerous and detrimental to the public welfare of the citizens of Little Rock; and, 13 WHEREAS, the condition of this structure constitutes a serious structural, fire and health hazard; 14 and, 15 WHEREAS, such structure is a public nuisance and is dangerous to the health and safety of the 16 occupants or other persons and, further, is in such condition as to be dangerous to the lives, limbs and 17 property of people in its vicinity or those lawfully passing thereby; and, 18 WHEREAS, such structure is declared a nuisance and immediate action is necessary to remedy these 19 situations and said building should be rehabilitated by the owner or razed either by the owner or the City 20 of Little Rock; 21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS: 23 Section 1. The Board of Directors hereby declares that the following structure constitutes a public 24 nuisance. The owner of the following described property is hereby ordered to immediately contact the 25 Planning and Development Department, Building Codes Division and entering into an agreement 26 providing for the immediate razing and removal of said structure within twenty-four (24) hours and to 27 complete such removal within seventy-two (72) hours of the effective date of this ordinance. While not 28 required by law to do so, the Planning and Development Department, Building Codes Division will 29 immediately attempt to notify the owner of the property listed below of the passage of this ordinance by 30 certified mail or personal service. 31 The property on which the condemned structure is located by street address and legal description is 32 hereafter set forth with the name of the owners of record, as follows: 33 (Page 1 of 2] 1 1. 2223 Wright Avenue: Owner: Lawrence Smith 2 1517 West 23`d Street, Little Rock,Arkansas 72206 3 Legal: Lot 145, Adams Replat# 1 4 Parcel ID# 34L-193-00-156-00 5 Zoning Classification: C-3, General Commercial 6 Ward# l 7 Status: Closed; former glass shop 8 9 Section 2. The conditions of the structure on the above-described property has been found to present 10 a structural, fire and health hazard and is dangerous to the health and safety of the occupants or other 11 persons, and further, the structure is in such condition as to be dangerous to the lives, limbs and property 12 of people in its vicinity or those lawfully passing thereby. 13 Section 3. The City Attorney is hereby authorized to institute such proceedings against such persons as 14 may be necessary in order to enforce the provisions of this ordinance so as to remedy the unsightly and 15 dangerous conditions brought about as a result of the failure of the owners thereof to maintain this property. 16 Section 4. The Planning and Development Department, Building Codes Division of the City of Little 17 Rock is also authorized to raze and remove said building and file and enforce a lien against said property 18 for the cost of razing and removing said structures pursuant to Section 20-32 of the Little Rock Code of 19 Ordinances. 20 Section 5.
