3 AN ORDINANCE TO ACCEPT THE VOLUNTARY ANNEXATION OF THE LITTLE
4 MAUMELLE SEWAGE PUMP STATION PROPERTY; TO ADD CERTAIN LANDS TO THE
5 CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES

7 WHEREAS, a petition for voluntary annexation (the "Petition ") was filed with the County Clerk
8 of Pulaski County, Arkansas on .June 21, 2005 by the City of Little Rock, Arkansas, for the use
9 and benefit of the Little Rock Sanitary Sewer Committee, by the owner of the hereinafter
10 designated lands praying that said lands be annexed to and made part of the City of Little Rock,
11 Arkansas; and,
12 WHEREAS, on August 2, 2005, the County Court of Pulaski County, Arkansas found that the
13 Petition was signed by a majority of the total number of the real property owners of the area to
14 be annexed and by the owners of the area to be annexed and by the owners of more than one -
15 half of the acreage of said area; and,
16 WHEREAS, said lands are contiguous to and adjoining the present corporate limits of the
17 City of Little Rock; and,
18 WHEREAS, an accurate map of said lands has been filed with and made a part of said
19 Petition; and,
20 WHEREAS, proper notice has been given for the time and in the manner prescribed by law;
21 and,
22 WHEREAS, all things pertaining thereto have been done in the manner prescribed by law and
23 that said lands should be annexed to and made part of the City of Little Rock; and,
24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
25 ROCK, ARKANSAS:
26 Section 1. The following described territory contiguous and adjoining the City of Little Rock,
27 Arkansas be and the same hereby is accepted as annexed to and made a part of the City of
28 Little Rock, Pulaski County, Arkansas, to -wit:

I ANNEXATION OF LITTLE MAUMELLE SEWAGE PUMP STATION PROPERTY
2 A tract of land situated in the SE A, NE A of Section 13, T -2 -N, R-1 4-W and in the NW Y4, SW Y4,
3 NW Y4 of Section 18, T -2 -N, R -13 -W, Pulaski County, Arkansas, as more particularly described
4 as follows:
5 Commencing at an iron pin at the Northwest corner of said NW Y4, SW Y4, NW A of Section
6 18; thence S 00 degrees 43 minutes 26 seconds W along the West line of Section 18 for a
7 distance of 286.60 feet to a Point of Beginning being 75 feet Northwesterly of the
8 Northerly right -of -way line of a railroad; thence S 56 degrees 12 minutes 27 seconds W
9 along a line being 75 feet Northwesterly of and parallel with said railroad right -of -way
10 line 205.45 feet; thence N 44 degrees 39 minutes 37 seconds W, 123.63 feet; thence S 56
11 degrees 12 minutes 27 seconds W, 200.00 feet to the Easterly line of a 50 -foot wide
12 waterline easement; thence S 44 degrees 39 minutes 37 seconds E along said easement
13 line 200.00 feet to the Northerly right -of -way line of said railroad; thence N 56 degrees
14 12 minutes 27 seconds E along said railroad right -of -way line 773.36 feet to the West
15 right -of -way line of Pinnacle Valley Road; thence N o3 degrees 04 minutes 22 seconds
16 along the West right -of -way line of said road 52.94 feet; thence continuing along said
17 West right -of -way line N 05 degrees 12 minutes 22 seconds E, 42.01 feet to a point
18 being 75 feet Northwesterly of the Northerly right -of -way line of said railroad; thence S
19 56 degrees 12 minutes 27 seconds @ along a line being 75 feet Northwesterly of and
20 parallel with said railroad right -of -way line 440.51 feet to the Point of Beginning;
21 A tract of land containing 1.951 acres (84,965 S.F.), more or less.
22 Section 2. Severabi/ity. In the event any title, section, paragraph, item, sentence, clause,
23 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional,
24 such declaration or adjudication shall not affect the remaining portions of the resolution which
25 shall remain in full force and effect as if the portion so declared or adjudged invalid or
26 unconstitutional was not originally a part of the resolution.
27 Section 3. Repealer. All laws and parts of laws inconsistent with the provisions of this
28 resolution are hereby repealed to the extent of such inconsistency.
