HomeMy WebLinkAbout19435ORDINANCE NO. 19,435 2 3 AN ORDINANCE REASSESSING THE BENEFITS TO BE RECEIVED BY 4 THE OWNERS OF EACH OF THE SEVERAL LOTS, BLOCKS, AND 5 PARCELS OF LAND WITHIN RIVERDALE LEVEE IMPROVEMENT 6 DISTRICT NO. 134 OF LITTLE ROCK, ARKANSAS; DECLARING AN 7 EMERGENCY; AND FOR OTHER PURPOSES. 8 9 WHEREAS, Riverdale Levee Improvement District No. 134 of Little Rock, 10 Arkansas (the "District ") is a duly created and existing municipal improvement district 11 organized under Ordinance No. 12,932, adopted by the City Board of the City of Little 12 Rock, Arkansas on May 21, 1974; and 13 WHEREAS, the duly appointed Board of Commissioners of the District has 14 determined that certain improvements (the "Improvements ") to the levee and drainage 15 system of the District are necessary in order to provide the continued protection and 16 benefits of the system, and has filed its report describing the Improvements and the 17 estimated cost thereof with the City Clerk; and 18 WHEREAS, the estimated cost of the Improvements is $375,000; and 19 WHEREAS, the Commissioners have determined, pursuant to law, that the cost 20 of the Improvements shall be assessed upon the real property of the District according 21 to the benefits received; and 22 WHEREAS, the Assessors for the District have filed their Certificate to 23 Reassessment List with the City Clerk and notice of the filing was published one time 24 on November 4, 2005 in the Arkansas Democrat - Gazette; and 25 WHEREAS, said Reassessment List shows that the benefits received by each and 26 every block, lot, and parcel of real property situated in the District total $5,892,478, 27 which amount equals or exceeds the local assessment thereon; [PAGE 1 OF 31 Ordinance Reassessing Benefits in Riverdale Improvement District I NOW, THEREFORE, be it ordained by the Board of Directors of the City of Little 2 Rock, Arkansas, that: 3 Section 1. The said several blocks, lots, and parcels of real property in the 4 District be reassessed according to the assessment list for the District as the same now 5 remains in the office of the City Clerk, and that 1.784 percent of the assessment of each 6 of said blocks, lots, and parcels shall be collected by the County Collector of Pulaski 7 County on or before October 10, 2006 and 1.784 percent of the assessment shall be s collected with the first installment of general taxes coming due in each year thereafter, 9 beginning in the year 2007, until the whole of said local assessment shall be paid. 10 Section 2. Severability. In the event any title, section, paragraph, item, 11 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 12 or unconstitutional, such declaration or adjudication shall not affect the remaining 13 portions of this ordinance, which shall remain in full force and effect as if the portion so 14 declared or adjudged invalid or unconstitutional was not originally a part of this 15 ordinance. 16 Section 3. Repealer. All ordinances and resolutions inconsistent with the 17 provisions of this resolution are hereby repealed to the extent of such inconsistency. 18 Section 4. Emergency. The Board of Directors hereby determines that the 19 District is in dire need of funds for making the Improvements and that an appropriate 20 way to provide such funds is by reassessment of the benefits received by each and 21 every block, block, and parcel of real property situated within the District, and that this 22 Ordinance shall be given immediate effect so that the new funds may be obtained as 23 soon as possible. Therefore, an emergency is hereby declared to exist and this 24 Ordinance being necessary for the immediate preservation of the public health, safety, 25 and welfare shall be in full force and effect from and after its passage and approval.
