3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH SCOTT CONSTRUCTION EQUIPMENT
5 FOR THE PURCHASE OF ONE (1) POTHOLE PATCHING TRUCK
6 FOR THE PUBLIC WORKS DEPARTMENT; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, the Public Works Department is in need of one (1) pothole patching
10 truck, and
11 WHEREAS, the truck will replace a 1994 model truck, and
12 WHEREAS, the City of Little Rock received bids under Bid #5324 for the
13 purchase of the pothole patching truck, and the lowest responsible and responsive bid
14 was received from Scott Construction Equipment in the amount of One Hundred
15 Eleven Thousand, Three Hundred Thirty -one Dollars ($111,331.00).
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
17 THE CITY OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby authorizes the City Manager to enter
19 into a contract for the purchase of one (1) pothole patching truck, for the amount of One
20 Hundred Eleven Thousand, Three Hundred Thirty -one Dollars ($111,331.00).
21 Section 2. Funds for this purchase are to be allocated from 2005 Short Term
22 Financing.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
24 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
25 unconstitutional, such declaration or adjudication shall not affect the remaining
26 portions of the resolution which shall remain in full force and effect as if the portion so

I declared or adjudged invalid or unconstitutional was not originally a part of the
2 resolution.
3 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
4 are inconsistent with the provisions of this resolution, are hereby repealed to the extent
5 of such inconsistency.
