HomeMy WebLinkAbout19427ORDINANCE NO. 19,427 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED MARCHANT AND REESE SHORT -FORM PD -R (Z- 6809 -A), LOCATED AT 700 SOUTH CEDAR STREET, LITTLE ROCK, ARKANSAS, AMENDING ORDINANCE NO. 18,287 AND THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 18,287 adopted by the Little Rock Board of Directors on June 30, 2000, be amended to provide for modification of the Planned Zoning Development described as Marchant and Rees Revised Short-form PD -O (Z- 6809 -A); SECTION 2. That the zoning classification of the following described property be changed from PD -C to PD -R: Lots 1, 2 and 3, Block 6, Reyburn and Wrights Addition to the City of Little Rock, Pulaski County, Arkansas, together with a 45.0 foot strip of land lying west of and adjacent to said Lots 1, 2 and 3 which is situated between the south right of way line of West 7t" Street and the North right of Way line of Interstate 630, said strip of land being formerly platted as Elm Street, vacated and abandoned by the City of Little Rock, Arkansas pursuant to Ordinance No. 13,592 and together with the W '/2 of that portion of the north -south alley in Block 6 of Reyburn and Wright's Addition to the City of Little Rock, Arkansas between the south right of way line of West 7t" Street and the north right of way line of I -630 as vacated and abandoned by the City of Little Rock, Arkansas pursuant to Ordinance No. 13,562. Less and Except the following described property: Begin at the southeast corner of Lot 3; thence westerly along the south line of Lot 3, 135.00 feet; deflect 89 degrees 31 minutes right; thence 14.1 feet; deflect 91 degrees 40 minutes right; thence 109.26 feet; deflect 11 degrees 41 minutes left; thence 26.33 feet; deflect 100 degrees 01 minutes right; thence 19.13 feet to the point of beginning. and Less and except that portion of land conveyed by E. Ray Kemp, Jr. and Margaret L. Kemp, his wife and Steven B. Blumreich and Susan M. Blumreich, his wife to the City of Little Rock, Arkansas, as described in warranty deed filed July 15, 1983, and recorded as instrument No. 83- 35766, records of Pulaski County, Arkansas. and Lot 15, Block 6 Reyburn and Wright's Addition to the City of Little Rock, Pulaski County, Arkansas less and except the following described property: Beginning at the southeast corner of said Lot 15; thence westerly along the south line of said Lot 15, 20.50 feet; deflect 113 degrees 02 minutes right; thence 25.0 feet; deflect 24 degrees 44 minutes left; thence 27.0 feet; deflect 91 degrees 42 minutes right; thence 10.0 feet; deflect 88 degrees 18 minutes right; thence 50.0 feet to the point of beginning. and Lot 16, Block 6, Reyburn and Wright's Addition to the City of Little Rock, Pulaski County, Arkansas, less and except the following described property: Beginning at the northeast corner of said Block 6; thence southerly along the east line of said Lot 16, 50.0 feet to the southeast corner of said Lot 16; thence westerly along the south line of said Lot 16, 10.0 feet; deflect 88 degrees 18 minutes right; thence 50.0 feet to a point on the north line of Lot 16; thence easterly along the north line of said Lot 16, 10.0 feet to the point of beginning, and Together with the east `/2 of the north -south alley in Block 6, Reyburn and Wright's Addition to the City of Little Rock, Pulaski County, Arkansas lying west of and adjoining Lots 15 and 16, Block 6, Reyburn and Wright's Addition to the City of Little Rock, Pulaski County, Arkansas, pursuant to Ordinance No. 13,562. Blumreich, his wife, to the City of Little Rock, Pulaski County, Arkansas, as described in Warranty Deed File July 15, 1983, and recorded as Instrument Number 83- 35766, records of Pulaski County, Arkansas. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Marchant and Reese Short-form PD -R is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. 2 SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
