3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 APPROVE ADDITIONAL CONSULTANT FEES IN THE AMOUNT
5 OF $26,500.00 TO THE BENHAM COMPANY FOR DESIGN WORK
6 ON PARK IMPROVEMENTS AND SOCCER FIELDS; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, The Benham Company has been working on three options through
10 design development for park improvements and soccer fields on property near
11 Garrison Road, and
12 WHEREAS, none of the three options considered to this point have come under
13 budget due to the sites considered for soccer fields and parking areas being on a hilly
14 terrain, which requires removal of large quantities of rock, and
15 WHEREAS, a fourth site has been located in a less hilly area and closer to
16 Garrison Road which will reduce excavation and road construction costs and allow the
17 project to come in within the remaining budget;
18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
19 THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The City Manager is authorized to approve additional consultant
21 fees in the amount of $26,500.00 to The Benham Company for completion of the design
22 work for the improvements to the park and soccer fields to be located on property near
23 Garrison Road.
24 Section 2. Funds for the additional cost of this project are available through
25 the 2004 Bond Funding.
26 Section 3. Severability. In the event any portion of this resolution is declared or
27 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not

I affect the remaining portions of this resolution, which shall remain in full force and
2 effect as if the portion so declared or adjudged invalid or unconstitutional was not
3 originally a part of this resolution.
4 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which
5 are in conflict with any provision of this resolution are hereby repealed to the extent of
6 such conflict.
