3 AN 'ORDINANCE TO ABANDON A PORTION OF 9th STREET
4 NEAR CORNING AVENUE; TO APPROVE USE OF THE
5 PROPERTY BY THE LITTLE ROCK AIRPORT COMMISSION;
6 TO DECLARE AN EMERGENCY;AND FOR OTHER PURPOSES.

8 WHEREAS, expansion to the Little Rock National Airport has resulted in the creation of new ap-
9 proaches to the Airport, and areas along what was once Ninth Street are now needed for other airport pur-
10 poses; and,
11 WHEREAS, with the roundabout built on a portion of Ninth Street essentially abandons the balance
12 of the street, and it is the desire of the Board of Directors that all of the right of way that was part of the
13 street now be dedicated for the use and benefit of the Little Rock National Airport;
14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights,
17 together with the rights of the public, in and to the street right-of-way, identified below, for street and
18 transportation purposes,pursuant to its authority under Ark. Code Ann. §14-54-104(West 2004),provided
19 that the property contained in this right-of-way abandonment shall now be directed to the use and benefit
20 of the Little Rock Airport Commission:

22 A Portion of East 9th Street more particularly described as follows:
23 Closure of East 9th Street between the East Right-of-way of Corning Ave to a
24 point approximately 1214 feet east along East 9th Street, also described as
25 bounded on the North by Lots 12& 13 of Block 7,Industrial Park Addition,Lots
26 12& 13 of Block 14,Industrial Park Addition, Lots 12& 13 of Block 17, Indus-
27 trial Park Addition, Lot 12 and the west 19 feet of Lot 13 of Block 25, Industrial
28 Park Addition, and bounded on the South by Lots 1 & 22 of Block 6, Industrial
29 Park Addition, Lots 1 & 22 of Block 15, Industrial Park Addition, Lots 1 & 22
30 of Block 16, Industrial Park Addition, Lot 1 and the west 17 feet of the 20 feet
31 alley between Lot 1 &Lot 12 of Block 26, Industrial Park Addition.

33 Section 2. The City specifically retains the right to use,and allow others to use,the former street right-
1 of-way in its entirety as a public utility,drainage,and navigation easement to the extent that such easements

2 are compatible with the operations of the Bill &Hillary Clinton National Airport and do not interfere with
3 the City's ability to comply with all state and federal regulations applicable to the Airport.
4 Section 3. Any cost of removal of vestiges of public use required shall be borne by,or at the direction
5 of,the Little Rock Airport Commission, provided that no such costs shall be borne by the City.
6 Section 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of
7 the Recorder of Pulaski County and recorded in the records of the County.
8 Section 5. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
9 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconsti-
10 tutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if
11 such invalid or unconstitutional provision were not originally a part of this ordinance.
12 Section 6. Repealer. All laws,ordinances,resolutions,or parts of the same that are inconsistent with
13 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
14 Section 7. Emergency Clause. There is an immediate need to close a portion of 9t Street and to bring
15 the control of that closed right-of-way under the authority of the Little Rock Airport Commission to help
16 accomplish airport purposes; an emergency is, therefore, declared to exist, and this Ordinance shall take
17 effect immediately upon adoption.
