HomeMy WebLinkAbout20777 1 ORDINANCE NO. 20,777 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF 4 COMPETITIVE BIDS AND TO AUTHORIZE AN AGREEMENT 5 BETWEEN THE CITY OF LITTLE ROCK, ARKANSAS, AND LITTLE 6 ROCK REGIONAL CHAMBER OF COMMERCE TO PROVIDE 7 ECONOMIC DEVELOPMENT ASSISTANCE; TO DECLARE AN 8 EMERGENCY; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the City of Little Rock, Arkansas, benefits from economic development opportunities 11 both within the corporate limits of the City but does not have a staff that is capable of all of the groundwork 12 contacts,and other matters that have to be taken care of as part of an economic development program; and, 13 WHEREAS,working through the Little Rock Regional Chamber of Commerce the City has been able 14 to contract for such services which in the past have resulted in a substantial increase in the number of 15 companies that have located within the City with the concomitant increases in tax revenues,jobs, and new 16 residents; and, 17 WHEREAS, this program with the Greater Little Rock Chamber of Commerce is unique, and that 18 makes it impractical and unfeasible for the City to select such a program through formal competitive bid- 19 ding;and, 20 WHEREAS, pursuant to Section 6 of Little Rock, Ark., Ordinance No. 20,671 (December 18, 2012), 21 the Board of Directors budgeted Two Hundred Thousand Dollars ($200,000.00) for this contract with the 22 Little Rock Regional Chamber of Commerce; 23 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK,ARKANSAS: 25 Section 1. The Board of Directors authorizes the Mayor,and any other necessary officials,to execute 26 an agreement in substantially the form as that attached as Exhibit A to this ordinance,with the Little Rock 27 Regional Chamber of Commerce to provide economic development marketing services for the City during 28 2013 in an amount not to exceed Two Hundred Thousand Dollars($200,000.00). 29 Section 2. Because of the unique nature of the Metro Little Rock Alliance, as it is operated in con- 30 junction with the Little Rock Regional Chamber of Commerce, the City finds that it is impractical and 31 unfeasible to purchase some services through formal competitive bidding and, therefore, waives the re- 32 quirement of such bidding. [Page 1 of 2] 1 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 2 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 3 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 4 ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. 5 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 6 ordinance are hereby repealed to the extent of such inconsistency. 7 Section S. Emergency. Particularly in a difficult economy it is essential to the public health, 8 safety, and welfare, to assure that all steps are taken to attract economic development to the region that 9 will help secure new jobs, taxes, and residents for the City;development of economic opportunities working 10 through the Greater Little Rock Chamber of Commerce helps to accomplish these steps; the City has been 11 working with the Chamber on such projects since January 1, 2013, and the City ratifies all actions and 12 expenditures to date; and, because the City should continue to be involved in this economic development 13 activity; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect 14 from and after the date of its passage. 15 PASSED: August 27,2013 16 ATTEST: APPROVE 17 18 �� , Jh A Toya jbinson,AsOtani City Clerk Mark Stodola,M.*•r 20 APPROVED AS TO LEGAL FORM: 21 22 Aft ek.14,L, 23 Thomas M.
