RESOLUTION NO. 6,018
A RESOLUTION APPROVING CONSTRUCTION OF A CLOSURE
OVER PUBLIC UTILITY EASEMENTS AND FIRE LANES ON
BISHOP STREET BETWEEN 10TH AND 11TH STREETS;
AND FOR OTHER PURPOSES .
WHEREAS, the Board of Directors of the City of Little Rock,
upon the petition of Immanuel Baptist Church, held the necessary
public hearings as required by law and adopted Ordinance No. 13 , 327
vacating and closing Bishop Street between 10th and 11th Streets;
and
WHEREAS, Bishop Street is already partially closed to the south
of 10th and 11th Streets and will be closed to the north in the future
by the proposed Wilbur Mills Freeway; and
WHEREAS, Immanuel Baptist Church proposes to expand its facili-
ties as per the attached Exhibit "A" and such expansion would require
closing approximately 90 feet of the south end of the Bishop Street
fire lane and utility easement on the closed street; and
WHEREAS, Immanuel Baptist Church has arranged with the utility
companies for the relocation and maintenance of the lines; and
WHEREAS , Immanuel Baptist Church has assured the City that the
remainder of the fire lane on this block will be permanently main-
tained without future requests for closure in order to maintain ade-
quate access for fire vehicles to the Immanuel facility.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Approximately 90 feet of the south end of the Bishop
Street fire lane and utility easement between 10th and 11th Streets
as indicated on Exhibit "A" is hereby closed.
SECTION 2. The construction proposed by Immanuel Baptist Church
over the easement is hereby approved.
SECTION 3 . The closure and the approval of the construction
are conditioned upon the promise by Immanuel Baptist Church that the
City of Little Rock will be held harmless for any and all expenses
and injuries that result from, are caused by, or in any manner are
related to, the construction, maintenance and operation of the closure
and the facilities.
SECTION 4 . They are further conditioned on Immanuel Baptist
Church taking all responsibilities for costs in relocating and main-
taining public utilities in the easement.
SECTION 5. The approval and closure are also conditioned upon a
promise that the remainder of the fire lane on the block in question
will be permanently maintained without future requests for closure in
order to maintain adequate access for fire vehicles to the Immanuel
Baptist Church facilities.
SECTION 6 . This Resolution shall be in full force and effect of
and from the date of its adoption.
