HomeMy WebLinkAbout5849 RESOLUTION NO 5,849 A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE A MUTUAL COOPERATION AGREEMENT FOR ENFORCEMENT OF CITY-STATE REGULATIONS IN CAPITOL AND MANSION AREAS OF THE CAPITOL ZONING DISTRICT; AND FOR OTHER PURPOSES BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1 . The City Manager is hereby authorized to approve a Mutual Cooperation Agreement with the Capitol Zoning District Commission for enforcement of City-State regulations in the Capitol and Mansion Areas of the Capitol Zoning District. The procedures to be established in such agreement are set out and contained on Exhibit "A" which is attached to this Resolution and made a part hereof the same as though set out herein word for word. SECTION 2 . This Resolution shall be in full force and effect from and after its adoption. ADOPTED: November 15, 1977 ATTEST: APPROVED: City Cler Mayor • EXHIBIT "A" CAPITOL ZONING DISTRICT COMISSION November 7, 1977 Mr. Carlton McMullin City Manager City of Little Rock City Hall Little Rock, AR 72201 Re: Mutual Cooperation for Enforcement of City-State Regulations in Capitol and Mansion Areas of the Capitol Zoning District Dear Mr. McMullin: Act 267 of 1975 along with the Capitol Zoning District Master Plan adopted on October 4, 1977 and the Capitol Zoning District's Administra- tive Rules and Procedures adopted October 27, 1977 transfer land use control of the areas known as the Capitol Area and the Mansion Area, more particularly described in the Act, to the Capitol Zoning District Commission. The staff of this Commission has discussed with your office Section 4 of Act 267 which provides for a cooperative agreement between the Capitol Zoning District Commission and the City of Little Rock if it is determined by the Commission and the City that such an agreement would provide for more effective management of the area. In accordance with this statute, we respectfully request the following procedures be established within the Office of the Little Rock Community Services Department and the Office of Comprehensive Planning: (1) Refer all applicants requesting permits for improvements within the jurisdiction of the Capitol Zoning District Commission to Room 410, Contenental Building, Markham at Main, Little Rock, Arkansas. (Telephone: 371.1553) . Permit requests to be referred are: (a) Building Permits (b) Sign Permits (c) Grounds Permits (d) Privilege Licenses (e) Demolition Permits (f) Certificate of Occupancy (g) Certificate of Compliance (2) Any requests for a Conditional Use Permit or a Variance shall "t be referred to the Administrator of the Capitol Zoning District Commission for review by the staff and action by the Capitol Zoning District Commission. (3) Prior to issuance of the Little Rock Certificate of Occupancy or Privilege License, the Commission requests that you notify the Administrator of the Capitol Zoning District Commission in order that a final inspection may be made of the improvements. A memorandum will be forwarded to the city after the inspection has been successfully completed which will indicate that from a zoning perspective the occupancy permit should be issued. The Capitol Zoning District Commission will have sole authority for the issuance of a Grounds Permit, a Significant Structure Permit, and a Certificate of Compliance within the district boundaries. A Building Permit and Sign Permit will be issued by the City of Little Rock following review for compliance by the Commission and certification that the improvements represented to the Commission will be made in accordance ~ with the laws of the State of Arkansas and the ordinances and codes of the City of Little Rock insofar as they are applicable. All regulations, requirements, codes, and enforcement responsibilities of the City of Little Rock not specifically mentioned in the Capitol Zoning District Ordinance shall continue to be in force in the district areas. This agreement shall be in effect until either or both parties give notice of termination or modification of the agreement. If the above procedures meet with your understanding of previous agreements and approval, please indicate such agreement and approval by signing and returning the enclosed copy of this letter.
