RESOLUTION NO 5,792
A RESOLUTION APPROVING THE SALE OF A STRIP OF LAND
OWNED BY THE LITTLE ROCK MUNICIPAL WATER WORKS, NORTH
OF MARKHAM STREET & WEST OF SHACKLEFORD ROAD; AND
FOR OTHER PURPOSES
WHEREAS, the City holds title for the use and
benefit of the Little Rock Municipal Water Works to the
following lands in Pulaski County, Arkansas, hereinafter
called "old easement" , and more particularly described as
follows:
The south 50 feet of the NW4 of the NE4
of Section 4, Township 1 North, Range 13
West, in Pulaski County, Arkansas;
and
WHEREAS, the old easement was acquired for the
purposes of installing a raw water pipeline from Lake Winona
to the Ozark Treatment Plant; and
WHEREAS, at the time of actual installation of the
aforesaid pipeline, it was located outside of the old easement
except at one end thereof; and
WHEREAS, the Board of Commissioners of the Little
Rock Municipal Water Works has deemed the old easement to be
surplus property and desires to acquire the following described
easement for the aforesaid raw water pipeline, hereinafter
called the "new easement" , and more particularly described
as follows:
An easement 15 feet in width in the
NE4 of Section 4, Township 1 North,
Range 13 West, Pulaski County, Ark-
ansas, being 7 . 5 feet on each side
of the center line of an existing
39-inch raw water pipeline; said
center line more particularly de-
scribed as follows : Beginning at a
point on the east line of the NW4 of
the NE4 of said Section 4, which
point is 2 . 92 feet N 01° 00 ' 24" W of
the Southeast corner thereof; thence
S 89°54 ' 04" W for a distance of
794. 75 feet; thence S 89°48 ' 54" W for
a distance of 535. 64 feet to a point
on the West line of the SW4 of the
NE4 of said Section 4;
and
WHEREAS, Louis C. Nelson and Maurine H. Nelson,
his wife, are the owners of the land surrounding the old
easement (hereinafter called "the Grantees") and desire to
purchase the old easement at its fair market value and have

agreed to convey the new easement to the City for the use
and benefit of the Little Rock Municipal Water Works without
cost to the City; and
WHEREAS, the Board of Commissioners of the Little
Rock Municipal Water Works has had the old easement appraised
by C. V. Barnes, a professional real estate appraiser, who
has determined that the old easement has a fair market value
of $37, 924. 00; and
WHEREAS, the Board of Commissioners of the Little
Rock Municipal Water Works has requested the City to sell
the old easement at its appraised value to Grantees on
condition that the City receive the new easement upon terms
and conditions satisfactory to the Water Works and that
Grantees dedicate to the City as a right-of-way for West
Markham Street all lands between the existing north right-
of-way line of West Markham Street and the south line of the
new easement;
NOW, THEREFORE, BE IT RESOLVED by the Board of
Directors of the City of Little Rock, pursuant to the request
of the Board of Commissioners of the Little Rock Municipal
Water Works, that the Mayor and City Clerk be, and they are,
hereby authorized to execute a deed to Grantees to the old
easement in consideration of Grantees paying to the Little
Rock Municipal Water Works the sum of $37, 924 . 00 and all
costs of the conveyance, including closing costs , attorneys '
fees, documentary stamps and other expenses, and for a
further consideration of Grantees conveying to the City for
the use and benefit of the Little Rock Municipal Water Works
the new easement upon such terms and conditions as the Board
of Commissioners of the Little Rock Municipal Water Works
deems necessary, and for a further consideration of Grantees
conveying to the City of Little Rock all of the lands between
the north line of the existing right-of-way of West Markham
Street and the south line of the new easement for use by the
City as a right-of-way for West Markham Street.
PASSED AND UNANIMOUSLY ADOPTED this 6th day of
September, 1977.
