HomeMy WebLinkAbout5691 - RESOLUTION NO 5,691 A RESOLUTION GRANTING A SUBSURFACE FRANCHISE FOR THE CONSTRUCTION OF FOOTINGS WITHIN THE PUBLIC RIGHTS OF WAYS OF CERTAIN STREETS AND ALLEYS IN THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. In addition to the air rights franchise granted to Pulaski Bank & Trust Company by Resolution No . 5, 261 of the Board of Directors adopted August 20 , 1974, the said Franchisee is further granted a subsurface franchise to construct, use, occupy and maintain footings for a building in the following described public rights of ways : A) Beginning at the Northwest corner of the South one-half (Sz) of Block 7, Mountain Park Addition to the City of Little Rock, Ark . ; thence North 1. 083 ' (1 ' -1") ; thence East parallel to the North line of the of the South one-half (SZ) of said Block 7 301 . 83 ' ; thence South 117 . 51 ' to a point on the East line of the South one-half (S1/2) of said Block 7; thence N 0° 54 ' W along the East line of said South one-half (SZ) 116 . 44 ' to the Northeast corner thereof; thence West along the North line of said South one-half (SZ) Block 7 300 . 0 ' to the point of beginning, containing 433 . 545 square feet, more or less . B) Beginning at the Southeast corner of the South one-half (S 1/2) of Block 7 , Mountain Park Addition to the City of Little Rock, Ark. ; thence South 2 .58 ' (2 ' -7") ; thence West parallel to the South line of said South one-half of Block 7 302 . 083 ' ; thence North134 .92 ' to a point on the West line of the South one-half (SZ) of said Block 7, 132 . 36 ' to the South- west corner thereof; thence East along the South line of the South one-half (S1/2) of said Block 7 300 .0 ' to the point of beginning, containing 916 .48 square feet, more or less . SECTION 2 . The said subsurface footings shall be constructed in accordance with plans and specifications to be submitted to and approved by an authorized representative of the City of Little Rock prior to the beginning of such construction. SECTION 3 . The City of Little Rock in granting this franchise reserves the right to have said subsurface footings removed at the cost and expense of the franchisee, its successors and/or assigns if it should become necessary from the standpoint of the public welfare that same be removed. -2- SECTION 4 . It is hereby found that the construction herein authorized is needful and important from the standpoint of the public welfare and that the postponement of the effective date of this Reso- lution will cause harmful delay in the construction of said facility. Therefore, an emergency is hereby declared to exist and this Resolution being necessary for the preservation of the public welfare, peace and health, shall take effect and be in force from and after the date of its adoption.
