3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND TO AUTHORIZE THE CITY MANAGER
5 TO ENTER INTO A CONTRACT WITH TEREX EQUIPMENT
6 SERVICES, IN THE AMOUNT OF SEVENTY-FOUR THOUSAND, FIVE
7 HUNDRED SIXTY-THREE AND 20/100 DOLLARS ($74,563.20), AS THE
8 SOLE-SOURCE PROVIDER FOR MAJOR NECESSARY REPAIRS TO
9 THE STERLING BOOM TRUCK FOR THE PUBLIC WORKS STREET
10 OPERATIONS DIVISION; AND FOR OTHER PURPOSES.

12 WHEREAS, the Public Works Street Operations Division's Sterling Boom Truck, which includes a
13 twelve (12)-ton crane and is the only such vehicle in the City fleet, is in need of major necessary repairs;
14 and,
15 WHEREAS, Terex Equipment Services is the only provider of repairs to this type of equipment, and
16 competitive bidding should be waived and the contract awarded to Terex Equipment Services, as the sole-
17 source provider for the repairs to the Sterling Boom Truck, in amount of Seventy-Four Thousand, Five
18 Hundred Sixty-Three and 20/100 Dollars($74,563.20);
19 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. The Board of Directors hereby authorizes the City Manager to dispense with competitive
22 bidding and enter into a contract in the amount of Seventy-Four Thousand, Five Hundred Sixty-Three and
23 20/100 Dollars ($74,563.20), with Terex Equipment Services, as the sole-source provider for the major
24 necessary repairs to the Public works Street Operations Division's Sterling Boom Truck.
25 Section 2. Funds for this purchase are available from Fleet Maintenance Drivelines account, 600031-
26 63315.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
31 ordinance.
32 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with
33 any provision of this ordinance are hereby repealed to the extent of such conflict.
