HomeMy WebLinkAbout5235 RESOLUTION NO. 5,235 A RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR DRAINAGE PURPOSES EXECUTED BY MARY ANN KEITH, CELE COOK, AND J. V. WRAPE , EXECUTOR OF THE ESTATE OF JO ANNA KEITH; AND FOR OTHER PURPOSES WHEREAS , Mary Ann Keith, Cele Cook and J. V. Wrape, executor of the estate of Jo Anna Keith, have executed a permanent easement in favor of the City of Little Rock for the purposes of construct- ing, maintaining and repairing a drainage structure and other related purposes to the following described property : Beginning at a point on the South property line of Lot 12 , which is 18 . 08 feet west of the southeast corner of Lot 12 , Block 2 , Ferndale Addition, thence deflect 55° 54 ' 50" right in a northwesterly direction a distance of 56 . 5 feet to a point on the west property line of Lot 12 , thence continuing 28. 90 feet along said northwesterly line to a point on Lot 11, thence deflect 15° 55 ' 10" left in a northwesterly direction a distance of 43 . 8 feet to a point on the west property line of Lot 11 , thence continuing 47 . 2 feet along said northwesternly line to a point on the north property line of Lot 10 , which is 13 feet east of northwest corner of Lot 10 and 137 feet west of the northeast corner of Lot 12 ; said easement containing 2 , 136 square feet, more or less . WHEREAS , the said easement is needed by the City of Little Rock to alleviate and correct drainage problems in the area. NOW, THEREFORE , BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. The Board of Directors hereby accept, in accordance with the contents of tine easement, a Drainage Easement, a copy of which is attached hereto and made a part hereof as though set out herein word for word. SECTION 2 . This Resolution shall be in full force and effect from and after its adoption. ADOPTED: June 18, 1974 ATTEST: 4 APPROVED: l.0 H(/a-04- City Clerk Mayor a DRAINAGE EASEMENT KNOW ALL MEN BY THESE PRESENTS : THAT we, Mary Ann Keith, unmarried; Cele Cook, a married woman owning and conveying in her own right; and J. V. Wrape, administrator of the Estate of Jo Anna Keith, deceased, pursuant to powers granted !I to him in this capacity, owning and conveying in our own right for and in consideration of the benefits accruing to us and to the public generally do hereby grant, bargain, sell and convey unto the City of Little Rock, and unto its successors and assigns forever a permanent right privilege , and easement with the right of ingress and egress across adjacent lands of the Grantors for the purpose of constructing, main- taining, and repairing a drainage structure, whether one or more, and appurtenances thereto, now and at different times in the future; no building may be constructed by the Grantors on lands subject to this easement but the Grantors may, at Grantors ' own risk, perform any other act upon said lands not inconsistent with the rights herein granted. Said easement being a strip of land six feet on either side of a line crossing Lots 10 , 11 , and 12 , Block 2, Ferndale Addition to the City of Little Rock, Arkansas , more particularly described as follows: Beginning at a point on the South property line of Lot 12 , which is 18 .08 feet west of the southeast corner of Lot 12 , Block 2 , Ferndale Addition, thence deflect 55° 54 ' 50" right in a northwesternly direction a distance of 56 . 5 feet to a point on the west property line of Lot 12 , thence continuing 28 .90 feet along said northwesternly line to a point on Lot 11, thence deflect 15° 55 ' 10" left in a northwesternly direction a distance of 43 . 8 feet to a point on the west property line of Lot 11, thence continuing 47 . 2 feet along said northwesternly line to a point on the north property line of Lot 10 , which is 13 feet east of northwest corner of Lot 10 and 137 feet west of the northeast corner of Lot 12 ; said easement containing 2 , 136 square feet, more or less . Grantors also grant for the consideration aforesaid a temporary right of easement fir construction purposes only, said easement being a strip of land four (4) feet on either side of the above described S. A -2- easement, which temporary easement will be required for construction purposes only and shall terminate upon completion of the drainage project to be constructed by the City of Little Rock, its agents or contractors . TO HAVE AND TO HOLD said easement, rights ,and privileges unto the said Grantee and unto its successors and assigns forever for the purposes aforesaid except that temporary easement described above which shall terminate upon completion of the drainage project and its acceptance by the City of Little Rock. AND said Grantots covenant with said Grantee, its successors , and assigns , that it shall have at all times the quiet use of said easement and the rights herein conveyed.
