RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE COOPERATION AGREEMENT BETWEEN THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK, ARKANSAS, AND THE CITY OF LITTLE ROCK, ARKANSAS, FOR THE CITY TO PROVIDE AN ADDITIONAL NONCASH GRANT-IN-AID OF $327,000. FOR THE EXTENSION OF THE 1973-74 NEIGHBOR- HOOD DEVELOPMENT PROGRAM, ARK A-9, TO DECEMBER 31, 1974. WHEREAS, the Housing Authority of the City of Little Rock, Arkansas, hereinafter called "Authority," has under date of May 31, 1974, submitted its application to the Department of Housing and Urban Development for financial assistance under Title I of the Housing Act of 1949, as amended, to carry out the extension of the Fourth Action Year (1973-74) Neighborhood Development Program, ARK A-9, to December 31, 1974; and WHEREAS, in order to meet the local share of cost for the activities included in the application it is necessary for the City of Little Rock, Arkansas, hereinafter called "City," to provide an additional $327 ,000. as noncash grants-in-aid for the extensions of the Neighborhood Development Program to December 31, 1974; and WHEREAS, HUD approval of the Application is conditioned on the execution of an Amendment to the Cooperation Agreement; bnd WHEREAS, in view of the above, the Authority and the City are desirous of executing an Amendment to the Cooperation Agreement, dated June 20, 1973. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the Mayor and City Clerk be and they are hereby authorized to execute said agreement for and on behalf of the City of Little Rock, Arkansas, and to take such further action as may be necessary to effectuate said Agreement. Section 2. This Resolution shall be effective immediately. ADOPTED: June 18, 1974 (1;— ATTEST: p.np� ( .L_ APPROVED: WOOUVaith ity Clela Mayor AMENDMENT TO THE COOPERATION AGREEMENT by and between THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK, ARKANSAS and THE CITY OF LITTLE ROCK, ARKANSAS (Re: Extension of the Neighborhood Development Program, ARK A-9, FOURTH Action Year 1973-74, to December 31, 1974, Grants-in- Aid) WHEREAS, on June 20, 1973 , the Housing Authority of the City of Little Rock, Arkansas, (hereinafter referred to as "Housing Authority") and the City of Little Rock, Arkansas, (hereinafter referred to as the City") , entered into a Cooperation Agreement for the execution of the Fourth Action Year (1973-74) Neighborhood Development Program, ARK A-9; and WHEREAS, the Housing Authority has under date of May 31, 1974, sub- mitted its application to the Housing and Urban Development Department for financial assistance under Title I of the Housing Act of 1949, as amended, to carry out the Extension of the Fourth Action Year (1973-74) , Neighborhood Development Program, ARK A-9 to December 31, 197,4; and WHEREAS, in order to meet the local share of cost for the activities included in the Amendatory Application it is necessary for the City to provide $527,550 noncash grant-in-aid as site improvement work within the Neighborhood Development Program Area , ARK A-9; and WHEREAS, HUD approval of the application is conditioned on the execution of an Amendment to the Cooperation Agreement; 4 NOW, THEREFORE, in consideration of the recitals hereof and of the mutual promises and covenants herein set forth, the parties hereby agree as follows: I ,+ 1. The City Agrees: a. To provide $527 ,550 noncash grant"--in-aid as the City's one-third share of the cost of the Neighborhood Develop- ment Program, ARK A-9 Amendatory Application dated May 31, 1974, which will extend the program to December 31, 1974, of which the City has of this date provided $200,550 to be used as a part of its one-third share. b. To enter into contracts for engineering and/or architect- ural services and construction prior to December 31, 1974, for site improvements or other eligible community facilities with local funds, in the NDP area, which will qualify for noncash grants-in-aid benefits in the amount of not less than $327 ,000. c. If the improvements are contracted by the City, to timely provide certification of the contract amounts, and at completion timely provide certification of actual costs. d. The City recognizes that Title VI of the Civil Rights Act of 1964 and the regulations and policies of the Department of Housing and Urban Development effectuating the Title and Executive Order 11063 prohibit discrimination on the ground of race,color, religion, sex, or national origin in the policies and practices of any public facility, and on the ground of race, color, or national origin in the policies of any educational institution, or hospital responsible for proposed credit to the locality's share of the cost of an urban renewal project receiving financial assistance from the United States. The City hereby assures the United States and the Secretary of Housing and Urban Development that the site improvements it may construct will be available to and serve all person without regard to race, color, religion, sex, or national origin. 2. The Housing Authority Agrees: a. To undertake thetlproject improvements and the other items as stated in the application to the extent feasible in order to carry out the Neighborhood Development Program, ARK A-9. 3. This Cooperation Agreement shall be terminated if the Application is not approved as proposed.
