HomeMy WebLinkAbout5200 RESOLUTION NO. 5,200 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DEED CONVEYING CERTAIN LANDS TO C. A. BARNETT AND G. 0. HARPER AND RETAINING A TEMPORARY CONSTRUCTION EASEMENT THEREON AND FOR OTHER PURPOSES . WHEREAS , on February 27 , 1974 , C. A. Barnett and G. 0. Harper conveyed to the City of Little Rock an easement over and across certain lands owned by them for the purposes of constructing under- ground drainage facilities in connection with the Geyer Springs Road widening project and accepted by Resolution No. 5,165 and; WHEREAS , a change in the construction plans of the said under- ground drainage facilities has eliminated the need of the entire permanent easement over and across said properties and; WHEREAS , the excess of the amount should be reconveyed to the original owners with the exception that a temporary easement should be retained over this excess amount until such time as the Geyer Springs Road widening project has been completed and accepted by the City of Little Rock. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1 . The Mayor and City Clerk are hereby authorized to execute on behalf of the City of Little Rock a Quitclaim Deed convey- ing the property not needed for the permanent easement originally conveyed by the said owners on February 27 , 1974 , to the original owners , C. A. Barnertt and G. 0. Harper, but retaining thereon a temporary construction easement, which construction easement shall terminate upon the completion of the Geyer Springs Road widening project. The lands to be herein conveyed are described as follows: Part of the Northeast Quarter of the Northeast Quarter of Section 1 , Township 1 South, Range 13 West, Pulaski County, Arkansas , more particularly described as follows: Starting at the Northeast corner of Section 1, Township 1 South, Range 13 West , thence South along the East line of Section 1 415 . 38 feet to a point; thence West of and perpendicular to said line 41. 77 feet to the point of beginning, said point being on the proposed westerly right of way line of Geyer Springs Road; thence South 00° 17 ' 39" West along said proposed right of way line a dis- tance of 5 . 20 feet to a point; thence South 73° 52 ' 59" West a distance of 207 . 35 feet to a point; thence North 16° 07 ' 53" West a distance of 5 . 00 feet to a point; thence North 73° 52 ' 59" East a distance of 208 . 76 feet to the point of beginning and containing 1041 square feet, more or less . -2- ALSO , starting at the Northeast corner of Section 1 Township 1 South, Range 13 West, thence South along the East line of Section 1 394 . 62 feet to a point; thence West of and perpendicular to said line 42 . 45 feet to the point of beginning, said point being on the proposed westerly right of way line of Geyer Springs Road; thence South 73° 52 ' 59" West a dis- tance of 214 . 76 feet to a point; thence North 16° 07 ' 53" West a distance of 5. 00 feet to a point; thence North 73° 52 ' 59" East a distance of 216 . 38 feet to a point on the proposed westerly right of way line of said Road; thence South 02° 55 ' 31" West along said proposed right of way line a distance of 5 . 29 feet to the point of beginning and containing 1078 square feet, more or less .
