HomeMy WebLinkAbout5062 RESOLUTION NO. 5,062 A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN EASEMENT IN KANIS PARK FOR A RIGHT-OF-WAY FOR A GAS PIPE- LINE, A METER STATION, AND OTHER RELATED PURPOSES , AND FOR OTHER PURPOSES BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1 . The Arkansas Louisiana Gas Company has requested, subject to the approval of the Board of Directors of the City of Little Rock, an easement through Kanis Park to maintain, alter, repair, operate and remove a pipeline or main for the transporta- tion of natural gas or gas products and for a station for meter or other related gas funtions . The land to be conveyed in the easement is described as follows : Beginning at a point on the South line of the SEQ of Section 2 , Township 1 North, Range 13 West, 851. 5 feet West of the Southeast Corner of said Section, thence West along the South line of said Section to the Southwest corner of the SEq of the SEq of said Section 2 , thence North along the West line of said SE4 SEa, Section 2 a distance of 35 feet to a point, thence East parallel with the South line of said Section to a point which is 50 feet North of the point of beginning, thence South a distance of 50 feet to the point of beginning. Said easement will be 35 feet wide during construction and will become 20 feet wide after completion of construction, being the South 20 feet of the strip of land herein described. AND A 50 foot by 50 foot Lot out of the Southeast Quarter of the Southeast Quarter of Section 2 , Township 1 North, Range 13 West, Pulaski County, Arkansas , being more particularly described as follows : Beginning at a 3/4 inch Iron Pipe 801. 5 feet West of the Southeast corner of said Section; thence West, (passing an existing pipeline at 5 feet) , a distance of 50 feet to a 1 inch Iron Pipe; thence North 00 06' West, (passing a staked survey line for a proposed 10 inch gas distribution line at 17 . 5 feet) , a distance of 50 feet to a 1 inch Iron Pipe; thence East, (passing an existing pipeline at ap- proximately 45 feet) , a distance of 50 feet to a 3/4 inch Iron Pipe; thence South 0° 06 ' East, 50 feet to the Point of Beginning, containing 0 . 06 acres more or less . -2- SECTION 2 . The Mayor is hereby authorized to sign the Easement conveying a right-of-way for the purposes above described across the above described lands to Arkansas Louisiana Gas Com- pany and the City Clerk is hereby authorized to attest said Ease- ment. Said Easement to be in form and substance as evidenced by a copy thereof attached to this Resolution. SECTION 3 . This Resolution shall be in full force and effect from and after its adoption. ADOPTED: September 4, 1973 ATTEST: 4"C-47 APPROVED : A44-GI elet: ity Clerk Mayor • EASEMENT KNOW ALL MEN BY THESE PRESENTS : That the CITY OF LITTLE ROCK, ARKANSAS, Grantor, by its Mayor and City Cierk, • being duly authorized by Resolution No. 57062 adopted by the Board of Directors of the City Of Little Rock, Arkansas , on • September 4 , 1973 , for and in consideration of the sum of $1. 00 and other good and valuable consideration, paid by ARKANSAS LOUISIANA C1'5 COMPANY, Grantee, receipt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell and convey unto said Grantee and its sucessors and assigns forever, an easement and right- of-way to lay, maintain, alter, repair, operate and remove a pipeline or main for the transportation of natural gas or gas products and for a :station for meter or other related gas functions, over and across he following described lands located in Pulaski County, Arkansas, to-wit: Beginning at a point on the South line of the SE% of Section 2, Township 1 North, Range 13 West, 851. 5 feet West of the Southeast Corner of said Section, thence West along the South line of said Section in the Southwest corner of `.':.e SE=4 of the SE a of said Section 2, thence North along the West line of said SE 4, SEA, Section 2 a distance of 35 feet to a point; thence • East parallel with the South line of said Section :o a point which is 50 feet North of the point of beginning, thence South a distance of 50 feet to the point of beginning. TO HAVE AND TO HOLD the same unto the said Grantee and unto its successors and assigns forever, together with all appurtenances thereunto belonging, and the right of ingress and egress to and from the same. And Grantor hereby agrees , for the consideration aforesaid, that it will bear all costs for future relocation of said pipeline and station made necessary by any future development in the above area.
