HomeMy WebLinkAbout4977 RESOLUTION NO. 4,977 A RESOLUTION ACCEPTING AN OFFER MADE BY BIRCH- BROOK, INC. , TO BUY A TRACT OF LAND IN THE LITTLE ROCK PORT INDUSTRIAL PARK DISTRICT FOR A PURCHASE PRICE OF $41, 382 . 00 ; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A WARRANTY DEED IN FAVOR OF BIRCH-BROOK, INC. , UPON PAY- MENT OF THE TOTAL PURCHASE PRICE; AND FOR OTHER PURPOSES NOW, THEREFORE , BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. Birch-Brook, Inc. , has submitted to the Little Rock Port Authority an offer to purchase a tract of land in the Little Rock Port Industrial Park District described as: Tract E , Area 201, containing 1. 90 acres, more or less which offer has been accepted by the Little Rock Port Authority subject to the approval of the Board of Directors of the City of Little Rock, Arkansas . The tract of land under consideration is more particularly described as follows: A parcel of land located in the Northwest Quarter of the Southeast Quarter of Section 16 , T-1-N, R-11-W, Pulaski County, Arkansas and being more particularly described as follows : Commencing at the Northwest corner of the South- east Quarter of Section 16 , T-1-N, R-11-W, thence N1031 ' 33" E , 496 . 48 feet along the West line of the Northeast Quarter of said Section 16 to the Northwest corner of the South 15 acres of the Southwest Quarter of the Northeast Quarter of said Section 16 , thence S 89°29 ' 08" E, 538. 93 feet along the North line of said South 15 acres to a point on the west R/W line of a 125 foot natural gas line easement, thence S 8°10 ' 35" W, 615 . 39 feet along said west R/W line to a point on the North R/W line of the Little Rock Port Railroad Sppur, thence con- tinue along said west R/W line S 8°10 ' 35" W, 63 . 62 feet across said R. R. R/W to a point on the south R/W line of said R. R. Spur, said point being the point of beginning. Thence continue S 8°10 ' 35" W, 383 . 82 feet along said West R/W line to a point on the North R/W line of Lindsey Road, thence S 74°54 ' 52" W, 200. 00 feet along the north R/W line of said Lindsey Road to a point, thence N 0°12 ' 52" W, 382 . 35 feet to a point on the south R/W line of said L. R. Port R. R. Spur, thence N 78°43 ' 34" E , 253 . 89 feet along the south line of the said R. R. R/W to the point of beginning. Said parcel contains 1. 90 acres more or less . SECTION 2 . The offer to purchase as set out in the Offer and Acceptance dated March 12 , 1973 , attached to this Resolution and incorporated therein by reference is thereby approved and accepted by the Board of Directors of the City of Little Rock, Arkansas, and the Mayor is hereby authorized and directed to execute for and on behalf of the City of Little Rock a Warranty Deed, subject to record restrictions and easements , if any , conveying said property to Birch-Brook, Inc., the City Clerk is hereby authorized and directed to attest said Deed and to deliver same to Birch-Brook , Inc. , upon full payment of the sum of Forty-one Thousand, Three Hundred Eighty- two Dollars ( $41, 382 . 00) . SECTION 3. This Resolution shall be in full force and effect from and after its adoption.
