A RESOLUTION AWARDING A CONTRACT FOR MODEL CITIES
SECOND YEAR DRAINAGE PROJECT ; AUTHORIZING PAYMENT;
AND FOR OTHER PURPOSES
WHEREAS , invitation to bid was duly advertised and bids
received pursuant thereto according to law for Second Year Drainage
improvements (Model Cities) in the City of Little Rock in accordance
with plans and specifications on file in the office of the Public
Works Department; and
WHEREAS , the lowest responsible and responsive bid received
pursuant thereto has been determined to be that of Bituminous , Inc. ,
of Pine Bluff, Arkansas and the Board of Directors is desirous of
awarding a contract to said successful bidder; and
WHEREAS , funding for the aforementioned drainage improvement
will be provided through the U. S. Department of Housing and Urban
Development and Model Cities Program.
NOW THEREFORE , BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. A contract is hereby awarded to Bituminous , Inc. ,
Pine Bluff, Arkansas for Second Year Drainage improvements (Model
Cities) within the City of Little Rock in the amount of $295, 751. 00
in accordance with plans , specifications and bid proposal on file in
the office of the Department of Public Works .
SECTION 2 . Said contract shall be in form and substance as
follows :

. WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned,to be
made and performed by the OWNER,the CONTRACTOR hereby agrees with the OWNER to commence and complete
the construction described as follows:

plemental General Conditions and Special Conditions of the Contract,the plans,which include all reaps,plats,blue
prints,and other drawings and printed or written explanatory matter thereof,the specifications and contract documents

and as enumerated in Paragraph I of the Supplemental General Conditions,all of which are made a part hereof and col-
lectively evidence and constitute the contract.
The Contractor hereby agrees to commence work under this contract on or before a date to be specified in a
written "Notice to Proceed"of the Owner and to fully complete the project within__ consecutive calendar days
thereafter. The Contractor further agrees to pay,as liquidated damages,the sum of S for each consecu-
tive calendar day thereafter as hereinafter provided in Paragraph 19 of the General Conditions.
The OWNER agrees to pay the CONTRACTOR in current funds for the performance of the contract,subject to
additions and deductions,as provided in the General Conditions of the Contract,and to make payments on account
thereof as provided in Paragraph:.5,"Payments to Contractor,"of the General Conditions.

SECTION 3. Upon completion of the work provided for by the
contract authorized in Section 1 hereof and satisfying in all respects ,
plans , specifications and bid proposal on file in the office of the
Public Works Department , the City Manager and Director of Finance are
hereby authorized and directed to issue the necessary warrant or warrants
in payment of the contract price as monies are provided by the U. S.
Department of Housing and Urban Development.
SECTION 4 . This Resolution shall be in full force and effect from
and after its adoption.
