HomeMy WebLinkAbout4732 t RESOLUTION NO. 4,732 A RESOLUTION AUTHORIZING THE CONVEYANCE OF AN EASEMENT FOR RIGHT-OF-WAY FOR A TRANSMISSION AND'"DISTRIBUTION LINE- TO THE ARKANSAS POWER AND LIGHT COMPANY FOR THE TOTAL SUM OF $53 ,200. 00 ; AND FOR- OTHER PURPOSES NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The Arkansas Power and Light Company has accepted, subject to the final approval of the Board of Directors of the City of Little Rock, Arkansas, an offer for the conveyance of an easement for right-of-way purposes for transmission and distribution lines over and across certain lands in the Little Rock Port Industrial District owned by the City of Little Rock, Arkansas, said offer being for the consideration of the sum of $2 ,000. 00 per acre for an area containing 26 . 6 acres more or less for a total con- sideration of $53 ,200. 00 , subject to the right of the City of Little Rock, its agencies and assigns to extend streets, roads and railroad spurs or tracts across the easement herein granted, which right is hereby reserved, as well as any rights incident to the pi/chase of this right of way which will not interfere with the transmission and dis- tribution lines for which this easement is granted. The right-of- way to be conveyed to the Arkansas Power and Light Company is located in Pulaski County, Arkansas and more particularly described as follows: A right of way 100 feet in width across part of the North Half of the NE1 of Section 20; the North Half of the North Half of Section 21; the North Half of the North Half of Section 22; and part of the SEA of the SE; of Section 15; all in Township 1 North, Range 11 West, Pulaski County, Arkansas, said right of way being 50 feet on each side of a centerline more parti- cularly described as follows: Beginning at a point 150 Feet North of and 600 feet more or less East of the SW corner of the NW; of the NE4 of said Section 20; thence East 11 ,200 feet more or less along a line 150 feet North of and parallel +, Y -2- to the South line of the North Half of the NE4 of Section 20, the North Half- of the North Half of Section 21 and the North Half of the North Half of Section 22 to an angle point at, or near, the East line of the NA of the NE4 of Section 22; thence Northerly 376 feet more or less to a point of TERMI- NATION in the centerline of- the Fourche Island Drain- age Levee 530 feet more or less North of and 35 feet more or less East of the SW corner of the NE4 of the NE4 of Section 22 . Also 'Beginning.--at-a:-point on the South line of the SEA of the SE4"-o± Section 15, 110 feet more or less East of the SW corner thereof; thence- continuing nor- therly 515 feet- more- or- less to a point of TERMINATION in the centerline of old Fourche Creek, 515 feet more or less North of and 170 feet more or less East of the SW corner of said quarter-quarter section, the right of way containing-26.6 acres more or less, excluding that portion across the Arkansas Power and Light Company substation tract. SECTION 2 . The offer to purchase the right-of-way as set out in an Offer and Acceptance dated October 29 , 1971 attached to this Resolution and incorporated therein by reference is hereby approved and accepted by the Board of Directors of the City of Little Rock and the Mayor is hereby authorized and directed to execute for and on behalf of the City of Little Rock an easement for right of way and the City Clerk is hereby authorized and directed to attest said easement upon full payment of the sum of $53 ,200. 00 .
