A RESOLUTION GRANTING A FRANCHISE TO
CONSTRUCT A RETAINING WALL IN THE
ALLEY ABUTTING LOTS 1, 2 and 3 and
THE NORTH ONE-HALF OF LOT 4, BLOCK 41,
ORIGINAL CITY OF LITTLE ROCK; AND FOR
OTHER PURPOSES
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS .
SECTION 1 . The owner or owners of the East 80 feet of Lots 1,
2 and 3 and the North z of Lot 4, Block 41, original City of Little
Rock are hereby granted a franchise to construct a five foot high
rock retaining wall West of and adjacent to the center line of the
alley abutting said lots and parts of lots to afford lateral support
to the property abutting thereon.
SECTION 2. This franchise is granted conditioned that the alley
is not immediately needed for public purposes. Should it become
necessary sometime in the future that said alley be devoted to a
public purpose then the owner or owners of said lots identified
herein shall be required to remove the wall and encroachment and
restore said property to its condition at the time of this grant at
the sole expense of said Franchisee and/or the successors in title
to the lands described.
SECTION 3. This Resolution shall be in full force and effect
from and after its adoption.
