3 AN ORDINANCE TO APPROVE A PLANNED ZONING
4 DEVELOPMENT AND TO ESTABLISH A PLANNED COMMERCIAL
5 DISTRICT TITLED MAGNOLIA HILL LONG-FORM PD-C (Z-8835-A),
6 LOCATED AT 5110 STAGECOACH ROAD, LITTLE ROCK,
7 ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY
8 OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

10 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
11 OF LITTLE ROCK,ARKANSAS:
12 Section 1. That the zoning classification of the following described property be changed from R-2,
13 Single-Family,to PD-C, Planned Development Commercial:
14 Part of the SE 1/4 Section 22, T-1-N, R-13-W, Pulaski County, Arkansas, more
15 particularly described as follows: Commencing at the center of Section 22, T-1-N, R-13-
16 W; thence S0°50'08"E 298.9 feet; thence SO°16'02"W 686.0 feet; thence S764.5 feet to
17 the point of beginning; thence N60°27'l 0"E 913.35 feet to the southwest corner of Lot
18 14 Tall Timber West Subdivision; thence along the boundary of Tall Timber West along
19 a 606.47-foot radius curve to the left having a chord bearing of S58°05'33"E and a chord
20 length of 161.8 feet; thence S65°29'11"E; along said Tall Timber West 311.68 feet to the
21 southwest corner of Tall Timber West; thence S 10°59'01"W 49.4 feet; thence
22 S38°05'51"W 342.52 feet; thence S34°44'04"W 26.8 feet; thence S52°58'22"E ten (10)
23 feet; thence S52°58'22"E ten (10) feet; thence along a curve to the left with a chord
24 bearing of S37°01'38"W 232.49 feet; thence S28°05'52"W 165.78 feet; thence
25 N74°15'57"W 799.3 feet; thence N225.60 feet to the point of beginning containing 14.7
26 acres, more or less.
27 Section 2. That the approval of Magnolia Hill Long-Form PD-C (Z-8835), located at 5110
28 Stagecoach Road, is subject to compliance with the following additional conditions:
29 • That the preliminary site development plan/plat be approved as submitted, including all
30 staff comments and conditions as outlined in the Planning Commission Agenda Staff
31 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
32 in paragraph H and subject to additional conditions imposed at the Planning Commission
33 Public Hearing as amended by the applicant. `

1 • The approval is not transferable and is limited to the ownership of WG "Buddy" and
2 Alda Ellis.
3 • All activities are to end by 10:00 PM.
4 • There are to be no fireworks displays associated with an event on-site.
5 Section 3. That the change in zoning classification contemplated for Magnolia Hill Long-Form PD-
6 C (Z-8835-A), located at 5110 Stagecoach Road, is conditioned upon obtaining a final plan approval
7 within the time specified by Chapter 36, Article VII, Section 36-454 (e)of the Code of Ordinances.
8 Section 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
9 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
10 necessary to affect and designate the change provided for in Section 1 hereof.
11 Section 5. That this ordinance shall not take effect and be in full force until the final approval of the
12 plan.
13 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
14 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
15 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
16 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
17 ordinance.
18 Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
19 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
