3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH IBM NOT TO EXCEED $3.6 MILLION FOR
5 DESIGN, IMPLEMENTATION, TRAINING AND SERVICES FOR
6 EQUIPMENT AND SOFTWARE UPGRADES; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, RFQ No. 12286 was issued on October 19, 2012, for the selection of a prime vendor for
10 design, implementation, training, and services of an active-active data center, and, the review committee
11 appointed by the City Manager identified IBM Corporation as the preferred company with which to
12 negotiate and enter into a contract;
13 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
14 OF LITTLE ROCK,ARKANSAS:
15 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with
16 IBM for design, implementation,training and services for equipment and software upgrades.
17 Section 2. In negotiations for the purchase of the items set forth in Section 1, the City Manager is
18 authorized to consider a cost no greater than $3.6 million, a figure that also includes any taxes required to
19 be paid.
20 Section 3. Funding in the amount of Two Million Dollars($2,000,000) is available through the 2013
21 Short-Term Financing Note, with the remainder being paid from the Information Technology
22 Department's allocation of the 2012 3/8-Cent Capital Tax Funding.
23 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
26 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
27 resolution.
28 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
29 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
