A RESOLUTION DIRECTING THE CITY ATTORNEY
TO IMMEDIATELY FILE SUIT FOR DECLARATORY
JUDGMENT AND TEMPORARY INJUNCTION PERTAIN-
ING TO THE DEMOTION OF J.B. YANCEY IN THE
POLICE DEPARTMENT AND HIS ATTEMPTED APPEAL;
AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS .
SECTION 1. The City Attorney is hereby authorized
and directed to institute an action in the Court of proper
jurisdiction naming the City of Little Rock Petitioner and
J.B. Yancey as Respondent praying for Declaratory Judgment
as to the law applicable and controlling the facts and cir-
cumstances surrounding the demotion of J.B. Yancey from the
rank of Sergeant to that of Patrolman in the Police Depart-
ment on August 5, 1968, and his subsequent attempt to appeal
said demotion to the Civil Service Commission of this City
and further pray for immediate and temporary injunctive re-
lief against a hearing on Mr. Yancey1s attempted appeal until
the Court has declared the law applicable to the facts.
SECTION 2. This Resolution shall be in full force
and effect from and after its adoption.
