HomeMy WebLinkAbout3995 RESOLUTION NO. 3,995 A RESOLUTION ACCEPTING AN EASEMENT FOR McKINLEY STREET BETWEEN THIRD STREET AND MARKHAM STREET; AND FOR OTHER PURPOSES . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. The City of Little Rock hereby accepts from the owners thereof, an easement for McKinley Street between Third Street and Markham Street, which street is to be developed and maintained by the owners thereof according to plans and specifications approved by the City of Little Rock. Said easement shall be in form and substance as follows: J • STREET EASEMENT WHEREAS, The Mall, Inc. , an Arkansas corporation, has leased certain properties in the city of Little Rock, Arkansas for a term to expire at midnight on the 31st day of December, 2026, which lease was recorded by the Clerk of the Circuit Court and Ex Officio Recorder of Pulaski County on December 28, 1966 in Record Book Vol. 1148, page 309; and WHEREAS, there are presently located at the intersection of South McKinley Street and West Third Street in the city of Little Rock two traffic barriers; and WHEREAS, it is the desire of The Mall, Inc. and the city of Little Rock to open South McKinley Street from West Third Street to West Markham Street, and to remove the barriers in the intersection of South McKinley Street and West Third Street in order to improve the flow of traffic in the area involved. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: 1 . That The Mall, Inc. does hereby grant a street easement to the city of Little Rock for a period to terminate at midnight on December 31 , 2026, on a tract of land in the SE 1/4, NE 1/4, Section 1 , T-1-N, R-13-W, Pulaski County, Arkansas, more particularly described as: Beginning at the northwest corner of the amended replat of Developer's Inc. , Subdivision (the northeast corner of Plaza Terrace Addition to Little Rock, Arkansas) at the south right-of-way line for Markham Street; thence S 88° 20' E along said south right-of-way line 35.0 ft. to a point; thence S 1° 42' W 631 .2 Ft. , to a point on the center line of West 3rd street; thence N 890 10' W along said center line 35 .0 ft, to a point on the west line of the amended replat Developer's Inc. , Subdivision (the east line of Plaza Terrace Addition) thence N i° 42' E along said west line • of the amended replat Developer's Inc. Subdivision 631 . 2 ft. to the point of beginning, containing 0. 507 acres, more or less, 2. That The Mall, Inc. agrees to construct and maintain the aforesaid street. f 3, That The Mall, Inc. agrees that the city of Little Rock shall, during the period of this grant of street easement, exercise the city's police powers over the street maintained on this easement as a part of South McKinley Street.
