A RESOLUTION ACCEPTING AND APPROVING THE
CLAIM OF MRS. BETTE WALKER SMITH FOR
DAMAGES TO TREES AND SHRUBBERY; AUTHORIZING
PAYMENT THEREFORE; AND FOR OTHER PURPOSES.
WHEREAS, the City of Little Rock has inadvertently
damaged certain trees and shrubbery on the property of Mrs. Bette
Walker Smith at 2701 Flakewood Road, Little Rock, Arkansas, through
the use of chemicals used to kill growth in a drainage ditch
adjacent to said property; and
WHEREAS, the lowest responsible and responsive appraisal
of said damages is in the amount of Two Hundred Twenty and 00/100
Dollars ($220.00) which the Board of Directors recognizes as being
reasonable and desires to pay.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The claim of Mrs. Bette Walker Smith for
damages to trees and shrubbery at 2701 Flakewood Road, Little Rock,
Arkansas, in the amount of Two Hundred Twenty and 00/100 ($220.00)
Dollars is hereby accepted and approved.
SECTION 2. The City Manager and Director of Finance
are hereby authorized to execute a warrant or warrants in payment
of above claim upon the execution by Betty Walker Smith of a Release
running in favor of the City of Little Rock, its agents, servants,
and employees which Release is to be prepared and/or approved by
the City Attorney.
SECTION 3. This Resolution shall be in full force and
effect from and after its adoption.
