A RESOLUTION GRANTING A RIGHT AND FRANCHISE
TO PLEASANT VALLEY, INC. FOR THE USE OF
CERTAIN PUBLIC RIGHT-OF-WAY UNDER VALLEY
CLUB CIRCLE IN THE CITY OF LITTLE ROCK;
AND FOR OTHER PURPOSES.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. Pleasant Valley, Inc. is hereby granted
the right, franchise and privilege to construct under certain
public streets in the City of Little Rock a passage way in the
nature of an underpass under Valley Club Circle within the
following described boundaries:
A 10-foot strip, the centerline more parti-
cularly described as follows:
Commencing at the southeast corner of Lot 19,
Block 6, Pleasant Valley Addition to the City
of Little Rock, Arkansas;
Thence South 0° 07 ' 08" West along the East
right-of-way line of Valley Club Circle for
a distance of 47.76 feet to the Point of
Beginning;
Thence North 59° 52' 52" West for a distance of
57.74 feet to a point on the West right-of-way
line of Valley Club Circle;
and
A 10-foot strip, the centerline more parti-
cularly described as follows:
Commencing at the northwest corner of Lot 1,
Block 6, Pleasant Valley Addition to the City
of Little Rock, Arkansas;
Thence North 13° 52 ' 30" East along the East
right-of-way line of Valley Club Circle for a
distance of 569.89 feet to the point of curva-
ture of a curve to the right, said curving
having an internal angle of 19° 6' 17", a
radius of 415.74 feet, and a tangent of 69.96 feet;
Thence along said curve to the right for a distance
of 138.63 feet to the Point of Beginning;
Thence North 25° 0' 37" East for a distance of
57.77 feet to a point on the West right-of-way
line of Valley Club Circle.
The right, privilege, and franchise herein granted is for the pur-
pose of providing a passage way for users of the adjacent golf
course to walk or drive from one side of the said Valley Club
Circle to the other at will.
SECTION 2. The construction of said underpass
shall be in accordance with the applicable ordinances of this
City and shall in no manner interfere or be permitted to inter-
fere with or diminish the safety of persons using the road-way.
The franchisee, its successors and assignes, by exercising the
rights granted under this franchise shall be deemed to covenant
and agree that in the event the above property shall be needed
for other public purposes then upon demand by the City of Little
Rock and at the sole expense of the franchisee, its successors
and assigns, the premises shall be restored to its condition
prior to the construction of the underpass.
SECTION 3. The franchise herein granted shall take
effect immediately upon the recordation of a plat of a portion of
Pleasant Valley Addition to the City of Little Rock dedicating
the lands described in Section 1 hereof and establishing the
corners, lots and blocks used in the description in Section 1 hereof.
The City Manager, acting by and through the Department of Community
Development and any other agency of the City of Little Rock, shall
proceed to consider the development and construction plans now
and hereafter submitted by Pleasant Valley, Inc. taking into
consideration the grant of the franchise herein.
SECTION 4. This Resolution shall be in full force and
effect from and after its adoption.
