HomeMy WebLinkAbout3436 RESOLUTION NO . 3,436 A RESOLUTION AUTHORIZING TEE EXECUTION OF AN OFFER AND ACCEPTANCE CONTRACT FOR THE PURCHASE OF PROPERTY BY TAE CITY OF LITTLE ROCK FOR A SANITARY LAND FILL; AUTHORIZING PURCHASE OF CERTAIN LANDS; AND FOR OTHER PURPOSES . BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The Mayor and City Clerk are hereby authorized and directed to execute for and in behalf of the City of Little Rock, a certain instrument entitled "Offer and Acceptance" dated October 18, 1965, as more specifically described in Section 3 hereof . SECTION 2. Upon examination of title by the City Attorney, the City Manager and Director of Finance are hereby authorized and directed to issue the necessary warrant in payment of the purchase price of said property to the proper persons entitled thereto and the City Clerk is authorized and directed to accept a warranty deed and other necessary instruments to perfect title in the City of Little Rock. SECTION 3. The "Offer and Acceptance" instrument referred to in Section 1 hereof shall be in form and substance as follows: OFFER AND ACCEPTANCE We, Larkin L . Thornhill and Ruth Hill 'Thornhill, his wife, owners of the property hereinafter described, hereinafter called the Sellers , offer to sell to the City of Little Rock, Arkansas, -nereinafter called the Buyer, subject to the terms set fort:b, the following described property, to-wit : All the part of the Northeast Quarter of the Southwest Quarter (NEB; SWk) lying North of Fourche in Section 17, Township 1 North, Range 12 West, as shown in Pulaski County Record Book, Vol . 297 Page 522 August 2, 1943 except that part conveyed to J . H. Pennington described as part of the Northeast Quarter Southwest Quarter (NEB SWk) Section 17, Township 1 North, Range 12 West , described as Beginning at Northwest corner of said NE's SW1, thence South 315 feet , thence East 510 feet, thence North 315 feet, thence West 510 feet to point of beginning containing 3 .5 acres, more or less as shown in Deed Book 299 at page 430 of the records of the Circuit Clerk and Recorder of Pulaski County, Arkan- sas, containing 26. 75 acres more or less : and Part of Section 17, Township 1 North, Range 12 West described as beginning 385 feet West of Center of Section 17 thence Northeasterly N. 51/2 degrees East 300 feet , thence North SO degrees West 520 feet, thence South 51/2 degrees West 376 feet, thence East 500 feet to point of beginning containing 31/2 acres more or less and as described in deed of record in Book 305 Page 485 of the Records of the Circuit Clerk and Recorder of Pulaski County, Arkansas . Total acreage con- tained in this offer 30 .25 acres, more or less . Subject to the following conditions : The Seller will pay all general property taxes and special assessments due and payable at time of closing . Consideration to be paid for the described property shall be Seven Thousand Five Hundred and No/100 Dollars (57 ,500 .00) . Payment hercinabove mentioned shall be made in cash at the time Sellers ' deed or deeds are delivered. Conveyance shall be made by warranty deed except it shall be subject to all recorded restrictions and easements , if any . O t'' R AND ACCEPTLNCE Pa e,s Two Ti , Sellers will furnish title insurance acceptable to the } uyer in lieu of furnishing an abstract of title, but the Buyer etains the right at its own expense to procur an abstract of Litl.e and examine same and Sellers agree to correct reasonable objections to said title for which they shall have a reasonable time after being furnished notice of such reasonable objections . The Sellers specifically retain the right for a period of four years from the date of closing of this transaction to cut and remove from the premises all merchantable timber thereon and the proceeds from the sale of such timber shall belong to the Sellers ; provided, however, that if any standing timber interferes with the use of the City for the property and has not been removed at the time the City needs to use the property or any portion thereof the City may remove the timber and destroy same without any liability to the Sellers herein . It being specifically understood between the parties that any removal of the timber by the Sellers must be made prior to the City' s need for use of any portion of this land. Possession of the premises described shall be delivered within thirty (30) days from the date of closing . This offer shall remain open for seven (7) days from date .
