A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A DEED RUNNING IN FAVOR OF
THE STATE OF ARKANSAS TO CERTAIN LANDS LYING
WITHIN THE RIGHT-OF-WAY OF THE PROPOSED EAST-
WEST EXPRESSWAY; AND FOR OTHER PURPOSES.
WHEREAS, pursuant to long established arrangements
existing between the City of Little Rock and the State of
Arkansas, the City of Little Rock has procured and is now
able to furnish to the State of Arkansas sufficient title
in and to certain lands lying within the described bound-
aries of the proposed Last-West Expressway in the City of
Little Rock; and,
WHEREAS, the acquisition of said lands has been
completed, or is otherwise provided for, and it is nec-
essary that the City of Little Rock convey sufficient
interest to the said lands to the State of Arkansas, by
an instrument of conveyance, thereby vesting in the State
of Arkansas the complete and full right, title and interest
in said lanas for the purpose of laying out, constructing
and maintaining a limited access expressway;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor is hereby authorized and
directed to execute for and in behalf of the City of
Little Rock, and the City Clerk is authorized and directed
to attest to a certain deed conveying unto the State of
Arkansas certain described right-of-way within the proposed
East-West Expressway, as shall be more particularly des-
cribed in Section 2 hereof.
SECTION 2. The deed referred to in Section 1 hereof
to be executed by the Mayor and attested to by the City Clerk
is in form and substance as follows:

KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the City of Little Rock, Pulaski County, Arkansas, on
the day of , 1965, by resolution, authorized
and directed the Mayor to convey the hereinafter described property in
the City of Little Rock to the Arkansas State Highway Commission for
and in consideration of the same being used by the Arkansas State Highway
Commission for highway administrative, construction and/or maintenance
purposes.
WHEREAS, the described lands are for the construction, operation
and maintenance of the East - West Expressway in Little Rock from just
west of Coleman Creek to the west line of Jones Street and is intended
to be inclusive of all right of way required between described limits.
By reference, the right of way maps dated July 1965 for Job 6767, prepared
by Garver and Garver, Consulting Engineers, are made a part of this con-
veyance. If there be a variance between the description in this convey-
ance and the right of way maps for Job 6767, the right of way maps will
be used.
NOW, THEREFORE, I, Harold E. Henson, Mayor of the City of Little
Rock, a municipal corporation organized and existing under the laws of
the State of Arkansas, for and in consideration of the sum of One and
No/100 Dollars ($1.00) and other good and sufficient consideration, cash
in hand paid by the Arkansas State Highway Commission, the receipt of
which is hereby acknowledged, acting in behalf of the City of Little Rock,
Arkansas, do hereby grant, bargain, sell and convey unto the said Arkansas
State Highway Commission, its successors and assigns forever, the following
lands lying and being situated in the City of Little Rock, County of
Pulaski, State of Arkansas, to-wit:
Being a part of the South Half of Section 6, the South Half
of Section 5, and the Southwest Quarter of Section 4, all in
• Township 1 North, Range 12 West, Pulaski County, Arkansas,
more particularly described as follows:
Starting at the Northwest Corner of the Southeast Quarter of

on the Base Line of Right of Way Job 6767, East - West Express-

This conveyance is made for the purpose of a controlled access high-
way facility and the Grantor releases and relinquishes to the Grantee all
abutter's existing, future and potential common law or statutory rights
of access that the City may have between the main thoroughfare of such
highway facility and the Grantor' s remaining abutting and contiguous land
except that there is reserved and excepted to Grantor, its successors and
assigns, the right of direct access, as prescribed and limited by the
regulations and policies of the Arkansas State Highway Commission, to any
adjacent frontage road if established and while it may be maintained by
proper authority in front of said land ; provided that such policies and
regulations shall not prohibit entry onto the frontage road from the
abutting and adjoining lands, however, there shall be no right of direct
access from such frontage road to and from the nearest lane of the thru-
way or main travelled roadway, but such access shall be only at interchange
points as may be established and maintained by proper authority.
It is expressly intended that these covenants, burdens and restric-
tions shall run with the land and shall forever bind the Grantor, its
successors and assigns.
TO HAVE AND TO HOLD the same unto the Arkansas State Highway Commis-
sion and unto its successors and assigns forever, together with all and
singular, the tenements, appurtenances, and hereditaments thereunto
belonging or in any wise appertaining.
And the said City of Little Rock hereby covenants with the Arkansas
State Highway Commission that it will forever warrant and defend the
title to said lands against all lawful claims of any and all persons
whatsoever.
IN WITNESS WHEREOF the City of Little Rock, a municipal corporation,
has caused these presents to be signed by its Mayor, attested by its Clerk
and its Corporate Seal to be herewith affixed, all in accordance with
and pursuant to a resolution of its City Council, duly and regularly adopted,

SECTION 3. Upon execution of the said warranty
deed referred to in Sections 1 and 2 above, the City
Clerk is hereby authorized and directed to deliver same
to the State of Arkansas on or before August 31, 1965.
SECTION 4. This Resolution shall be in full
force and effect from and after its adoption.
