HomeMy WebLinkAbout3374 RESOLUTION NO. 3,374 A RESOLUTION ACCEPTING THE BID OF BRADCO CONSTRUCTION, INC. FOR REPAIRS AND IMPROVE- MENTS TO THE WEST THIRD STREET VIADUCT IN LITTLE ROCK; AUTHORIZING EXECUTION OF A CON- TRACT FOR THE PROSECUTION OF SAID WORK; AUTHORIZING PAYMENT; AND FOR OTHER PURPOSES. WHEREAS, invitation to bid was duly advertised and bids received pursuant thereto for certain work described as repairs and improvements of. the West Third Street Viaduct in Little Rock, Arkansas, all in accord- ance with law; and, WHEREAS, the lowest responsible and responsive bid received was the bid of Bradco Construction, Inc. , on a unit bid basis; and, WHEREAS, it appears that the work under the aforesaid bid will involve an expenditure by the City of Little Rock of not in excess of One Hundred Six Thousand, Seven Hundred Forty-Two and 20/100 Dollars (0106,742.20) and it is the desire of the Board of Directors to award the contract to the said Bradco Construction, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The bid of Bradco Construction, Inc. for repairs and improvements to the West Third Street Viaduct is hereby accepted. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to execute for and in behalf of the City of Little Rock a contract between the City of Little Rock and Bradco Construction, Inc., for the prose- cution of the aforesaid improvements, which contract shall be in form and substance as follows : CONTRACT THIS AGREEMENT made this day of , 19 by and between e' Constr�:etio� , Inc. (a corporation or- ganized and existing under the laws of the State of Arkansas (a partnership consisting of �: ) (an individual trading as ) (Strike out the two terms not applicable) hereinafter called the "Contractor", and City of Little Rock, Arkansas, here- inafter called the "Owner". WITNESSETH, that the Contractor and the Owner for the consideration stated herein mutually agree as follows: ARTICLE 1. Statement of Work. The Contractor shall furnish all super- vision, technical personnel, labor, materials, machinery, tools, equipment and services, including utility and transportation services, and perform and complete all work required for the Repairs and Improvements, West Third Street Viaduct, Little Rock, Arkansas, in strict accordance with the Contract Docu- ments, including all Addenda thereto, numbered dated July 20-, if and dated , as prepared by the Engineer. ARTICLE 2. The Contract Price. The Owner will pay the Contractor for the performance of the Contract in current funds, for the total quantities of work performed at the lump sum prices and unit prices stipulated in the Pro- posal for the several respective items of work completed subject to additions and deductions as provided in the paragraph Changes in the Work of GENERAL CONDITIONS. ARTICLE 3. Contract Time. The Contractor agrees to begin work within ten (10) calendar days after issuance by the Owner of a "Work Order" or "Notice to Proceed" and to complete the work within 150 calendar days there- after. This basic contract time of 150 calendar days is predicated on the jacking of nine (9) girder ends. If more than nine (9) girder ends require jacking, the contract time will be increased seven (7) calendar days for each girder end, additional to the nine (9) girder ends, which require jacking. ARTICLE 4, Contract. The executed contract documents shall consist of the following: a. This Agreement f. General Conditions b. Addenda g. Technical Specifications c. Notice to Contractors h. Drawings (as listed in the d. Instructions to Bidders List of Plans) e. Signed copy of Proposal C-1 This Agreement, together with other documents enumerated in this ARTICLE 4, which said other documents are as fully a part of the Contract as if here- to attached or herein repeated, forms the Contract between the parties hereto. In the event that any provision in any component part of this Contract conflicts with any provision of any other component part, the provision of the component part first enumerated in this ARTICLE 4 shall govern, except as otherwise specifically stated. IN WITNESS WHEREOF, the parties hereto have caused this AGREEMENT to be executed in five (5) original copies on the day and year first above written. Bradco Construction, Inc. As estimates shall be prepared and forwarded from the Engineer under and pursuant to the general conditions and other contract documents, the City Manager and Director of Finance are authorized and directed to issue the necessary warrant or warrants in payment of the contract estimate and upon acceptance by the Engineer and the City of Little Rock of the completed work, the aforesaid officers shall make final payment to the Contractor.
