RESOLUTION NO. 3,262
A RESOLUTION AUTHORIZING A CONTRACT WITH THE
METROPOLITAN AREA PLANNING COMMISSION OF
PULASKI COUNTY, ARKANSAS, FOR THE PARTICIPATION
AND EXERCISE OF CERTAIN RESPONSIBILITIES FOR
THE PLANNING AND PRESERVATION OF OPEN SPACE
LAND WITHIN THE CITY OF LITTLE ROCK; AUTHORIZING
THE EXECUTION THEREOF; AND FOR OTHER PURPOSES.
WHEREAS the Metropolitan Area Planning Commission, hereafter
called "Metroplan, " is capable of furnishing substantial service
to this City and the planning and preservation of open space land
within this City as a part of the available open space land plan-
ning program for the whole ofulaski County; and
WHEREAS it is the desire of this City to contract with the
said Metroplan pursuant to which it may assume certain responsi-
bilities for the planning and preservation of open space land
within the City of Little Rock; and
WHEREAS the Pulaski County School Listrict, North Little
Rock School District, Little Rock School District, City of Jackson-
ville, City of North Little Rock, and Pulaski County have agreed
to enter into the said agreement with Metroplan and have either
done so or appear to be ready, willing and able to execute said
agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS :
SECTION 1. There is hereby authorized a contract between
the City of Little Rock and the Metropolitan Area Planning Com-
mission of t=ulaski County, Arkansas, pertaining to the preserva-
tion and planning of open space land in and about the City of
Little Rock, the execution of which contract by the Mayor and
City Clerk is hereby authorized and directed.
SECTION 2. The form and substance of the contract and agree-
ment referred to in Section 1 hereof shall be `
as follows :
MEMORANDUM OF AGREEMENT RELATING TO THE PLANNING
AND PRESERVATION OF OPEN SPACE LAND IN
PULASKI COUNTY, ARKANSAS
This MEMORANDUM OF AGREEMENT, made this day of
, 1964 between the METROPOLITAN AREA PLANNING COM-
MISSION OF PULASKI COUNTY, ARKANSAS, created under the provisions
of the General Statutes of Arkansas, hereinafter called the "METROPOLITAN
PLANNING COMMISSION", and the Public Bodies (including county, cities,
towns, school districts and municipal districts created under general or
special law) located in Pulaski County, Arkansas, exercising, or participating
in the exercise of, responsibilities for the planning and preservation of open
space land in all or part of the Pulaski County Metropolitan Area, including
the acquisition of title to, or other permanent interests in, land to be reserved
or used as open space land, each of which public bodies is hereinafter called
a "PUBLIC BODY".
WHEREAS, THE METROPOLITAN PLANNING COMMISSION, pursuant to
the general statutes of the State of Arkansas, is (1) authorized to adopt and,
from time to time, amend, or extend a general plan for the development of
the Pulaski County Metropolitan Area, to serve as a general framework or
guide of development within which each part of the metropolitan area may be more
precisely planned, which metropolitan plan shall include, among other things,
a land use plan and proposals for the conservation and development of natural
resources, and (2) charged with assisting the local governments in the Pulaski
County Metropolitan Area in carrying out the metropolitan planning proposals;
and
WHEREAS, each such PUBLIC BODY in the Pulaski County Metropolitan
Area, pursuant to state law, exercises, or participates in the exercise of,
responsibilities for the planning and preservation of open space land in all or
part of the Pulaski County Metropolitan Area through the acquisition by gift,
purchase or condemnation of title to, or other permanent interests in un-
developed or predominantly undeveloped land which has value for park and
recreational purposes, conservation of land and other natural resources, or
historic or scenic purposes, and desires to cooperate with the METROPOLITAN
PLANNING COMMISSION and other public bodies in the planning and preservation
of such open space land in accordance with a metropolitan plan of development and
such other open space land policies and objectives as may be prepared and
adopted, and from time to time revised, by the METROPOLITAN PLANNING
COMMISSION: and
WHEREAS, Title VII, of the Housing Act of 1961 authorized the Housing
and Home Finance Administrator to help finance the acquisition of title to, or
other permanent interests in, open space land.
NOW, THEREFORE, THIS MEMORANDUM OF AGREEMENT WITNESSETH,
That the METROPOLITAN PLANNING COMMISSION and each PUBLIC BODY
do agree as follows:
1. It is the intention of the parties hereto to cooperate with each other in
the joint exercise of responsibility for the acquisition and preservation of
permanent open space land in the Pulaski County Metropolitan Area and in the
development of such plans, policies and procedures as will best promote that
objective.
2. As a basis for this cooperation, the METROPOLITAN PLANNING
COMMISSION has prepared and adopted a Comprehensive Development Plan
with appropriate parts thereof respecting open space land, and other open space
land policies and objectives.
3. As a basis for programs for the acquisition of title to, or other
permanent interests in, land to be used as open space land, the METROPOLITAN
PLANNING COMMISSION and each PUBLIC BODY shall prepare or cause to be
prepared a long-range open-space plan for the part or parts of the Pulaski
County Metropolitan Area for which such PUBLIC BODY exercises or participates
in the exercise of responsibilities for the preservation of open space land.
4. Prior to the acquisition of title,to, or other permanent interests in open
space land or, when federal aid will be sought, prior to the filing of an applica-
tion with the Housing and Home Finance Agency for a grant under Title VII, of
the Housing Act of 1961, each PUBLIC BODY shall submit each open space land
acquisition proposal to the METROPOLITAN PLANNING COMMISSION for review
as to conformance to the Comprehensive Development Plan and such other
comprehensive plan or plans or part thereof. Each open space land acquisition
proposal shall contain (1) a map showing the location of the land for which title,
or some other permanent interest, is to be acquired, and (2) a statement
describing the size and characteristics of the property, the interest or interests
to be acquired, the open space use or uses proposed for such land, and its re-
lationship to the open space plan of the PUBLIC BODY.
5. It is understood and agreed that the METROPOLITAN PLANNING
COMMISSION, and each PUBLIC BODY, in the preparation of long-range open
space plans, pursuant to paragraph 3, and of open space land acquisition pro-
grams, pursuant to paragraph 4, and generally in the exercise of responsibili-
ties for the preservation of open space land, shall be guided by the reviews,
plans and policies of the METROPOLITAN PLANNING COMMISSION, provided
that nothing herein contained is intended to require any PUBLIC BODY to take
any action which it is not authorized to take, or to refrain from taking any
action which it is required to take, pursuant to the Federal, State, or local law
under which such PUBLIC BODY is created or under which it exercises, or
participates in the exercise of, responsibilities for the preservation of open
space land in all or a portion of the Pulaski County Metropolitan Area.
6. This MEMORANDUM OF AGREEMENT shall take effect upon execution
by the METROPOLITAN PLANNING COMMISSION, and by the legislative bodies
of the City of Little Rock and City of North Little Rock, said public bodies com-
prising more than 60 per cent of the urban area as defined by the Housing and
Home Finance Administrator. Thereafter, additional public bodies may, from
time to time, execute this MEMORANDUM OF AGREEMENT and such execution
subsequent to the date of this MEMORANDUM OF AGREEMENT shall mt be
deemed to require its re-execution by the METROPOLITAN PLANNING COM-
MISSION, City of Little Rock, City of North Little Rock, and each Public Body
which had theretofore executed the same.
IN WITNESS WHERE OF, The parties have caused this MEMORANDUM OF
AGREEMENT to be executed and their seals hereon to be affixed, the day, month,
and year aforesaid.

SECTION 3. This resolution shall be in full force and effect
from and after its adoption.
