CODE 4 CHAPTER 32, DIVISION 4 - METERED PARKING, §§ 32-401 5 THROUGH 430; TO ESTABLISH PAY AND DISPLAY PARKING ZONES 6 WITHIN THE CITY OF LITTLE ROCK; TO ESTABLISH FINES FOR 7 VEHICLES ILLEGALLY PARKED IN METERED, PAY AND DISPLAY, 8 AND UNMETERED SPACES; TO DECLARE AN EMERGENCY; AND 9 FOR OTHER PURPOSES. 10 11 WHEREAS, after consideration of several issues related to the creation of pay and display parking 12 pay station zones within the City, it has been determined that modifications to Chapter 32 are necessary in 13 order to create such zones; and 14 WHEREAS, these modifications will establish the fines to be assessed for motor vehicles illegally 15 parked in metered, pay and display, and unmetered restricted parking spaces. 16 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK,ARKANSAS: 18 Section 1. A new Little Rock, Ark., Rev. Code § 32-411 (1988), Pay and Display Zone, is 19 hereby added as follows: 20 Sec.32-411.-Pay and Display Zone. 21 (a) No person shall park or permit to be parked any vehicle in a space controlled by a 22 "pay and display" parking pay station without properly displaying proof of payment as 23 described in this section. For parallel parking on one (1) and two (2)-way streets, proper 24 display of proof of payment requires affixing the receipt dispensed by the parking pay 25 station inside the vehicle to the front seat's side window nearest the curb in such a manner 26 that the expiration time and date are readily visible from the exterior. For motorcycles, 27 receipts shall be affixed on the headlight cover. No more than one receipt shall be 28 displayed. 29 (b) No person shall stop, stand or permit a vehicle within his control to be parked in any 30 parking space controlled by a "pay and display" parking pay station without displaying 31 on the vehicle an unexpired proof of payment receipt issued by a parking pay station. [Page 1 of 31 1 (c) No person shall stop, stand or permit a vehicle within his control to be parked in any 2 parking space controlled by a "pay by space" parking pay station beyond the amount of 3 time purchased for that space. 4 (d) No person shall park or permit to be parked any vehicle in a space controlled by a 5 "pay-by-space" parking pay station without payment properly recorded as described by 6 the instructions posted on the parking payment device. 7 Section 2. A new Little Rock, Ark., Rev. Code § 32-412 (1988), Penalties, is 8 hereby added as follows: 9 Sec.32-412.-Penalties. 10 The penalty for violation of overtime parking in all metered parking areas in sections 32- 11 401 through 32-411 not specified within a particular section shall be: 12 (a) Fifteen dollars($15.00) if paid within thirty(30)days of the issuance of the ticket; 13 (b) Fifty dollars ($50.00) if paid after thirty (30) days of the issuance of the ticket, or 14 after conviction in district court for violation of city parking ordinances. 15 A combination ticket and envelope shall be provided at the issuance of a violation 16 citation for the convenience of motorists. The penalty shall be paid by placing such sum 17 in the penalty box attached to the parking meters, or by paying the fine to the city. 18 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 19 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 20 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 21 ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. 22 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 23 ordinance are hereby repealed to the extent of such inconsistency. 24 Section 5. Emergency.
