A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO
ENTER INTO AND EXECUTE AN AGREEMENT WITH RUTH MAY WASSELL GIBB IN
SETTLEMENT OF A CERTAIN CONDEMNATION SUIT PENDING IN THE PULASKI
COUNTY CIRCUIT COURT WITH REGARDS TO PROPERTY LOCATED ON CANTRELL
ROAD; AND FOR OTHER PURPOSES.
WHEREAS, the City of Little Rock on the 5th day of May, 1960,
filed a condemnation suit in the Circuit Court of Pulaski County,
Arkansas, against certain property owned by Ruth May Wassell Gibb,
which suit is now pending; and
WHEREAS , in settlement of said suit, Mrs. Ruth May Wassell
Gibb by her Attorney, William Nash, has submitted a proposed agree-
ment; and
WHEREAS, the City of Little Rock desires to accept the terms
of said proposed agreement in settlement of said condemnation pro-
ceeding against Mrs. Gibb;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor and City Clerk are hereby authorized
and directed to enter into and execute on behalf of the City of
Little Rock an Agreement with Ruth May Wassell Gibb in settlement
of a condemnation proceeding against certain property therein de-
scribed owned by Ruth May Wassell Gibb on Cantrell Road in said
City, which Agreement shall be in form and words as follows:
A G R E E M E N T
WHEREAS , the City of Little Rock, Arkansas , has under
acquisition from Ruth May Wessell Gibb an easement over and across
the South 5 feet of Lots 25 and 26 and the South 5 feet of the
West 40 feet of Lot 24, Normandy Addition to the City of Little
Rock, for a cash consideration of $4,000.00 and for the further
consideration hereinafter set out;
NOW, THEREFORE, as further consideration for the acquisition
of the easement over and across the said lands , and further to in-
duce Ruth May Wassell Gibb to convey the said easement to the City
of Little Rock by special warranty deed, the City of Little Rock
agrees that it will construct , or will have constructed, without
cost to Ruth May Wessell Gibb, a wall located, of the material,
and in the manner specified according to plans and specifications
entitled, "Landscape Development Plans, Residence Mr. and Mrs. E. W.
Gibb, 6320 Cantrell, Little Rock, Arkansas ," dated May, 1960, and
prepared by Neil Hamill Park, which said plans and specifications
have been approved by the Office of the City Engineer of the City
of Little Rock and by the State Highway Department of the State
of Arkansas, except that Ruth May Wassell Gibb will provide at her
costs the facing of the said wall with brick according to the said
plans and specifications.
IN TESTIMONY WHEREOF, the City of Little Rock has caused this
instrument to be executed by its Mayor and attested with the seal of
the City affixed by its City Clerk this day of , 1960.
