A RESOLUTION AWARDING A CONTRACT TO A. P. T. CON-
STRUCTION COMPANY FOR THE EAST 6TH STREET DRAINAGE
PROJECT; AUTHORIZING PROGRESS PAYMENTS THEREFOR;
AND FOR OTHER PURPOSES.
WHEREAS, bids upon the East 6th Street Drainage Project
were advertised and taken according to law upon plans and specifi-
cations prepared by the Department of Public Works of the City
of Little Rock, Arkansas; and
WHEREAS, A. P. T. Construction Company was the low bidder
on said plans and specifications; and
WHEREAS, it is the desire of the Board of Directors of the
City of Little Rock to award a contract to A. P. T. Construction
Company;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The low bid of A. P. T. Construction Company in
the amount of Ninety Five Thousand Seven Hundred Eighty Two and
03/100 Dollars ($ 95 ,782.03 ) for the East 6th
Street Drainage Project in the City of Little Rock is hereby accepted.
SECTION 2. The Mayor and City Clerk are hereby authorized
and directed to enter into and to execute an agreement on behalf
of the City of Little Rock, Arkansas, with A. P. T. Construction
Company for the said East 6th Street Drainage Project, which agree-
ment shall be in form and words as follows:

That for and in consideration of the payment to be made as hereinafter set forth,
the Party of the First Part hereby agrees to furnish all tools, labor, equipment,
and materials, and to build and construct storm sewers, inlets, manholes,
and other appurtenances

satisfaction of the City of Litt le Rock Arkansas subject to
inspection at all times in accordance with uhe laws of the state of Arkansas.
It is agreed and understood between the parties hereto that the Party of the First
Part agrees to accept and the Party of the Second Part agrees to pay for the work
at the prices stipulated in said Proposal, such payment tc be in lawful money of
The United States, and the payment shall be made at the time and in the manner set
forth in the Specifications.
The 13arty of the first Part agrees, for the consideration above expressed, to
begin work within ten days after being ordered to begin work by the F;rgincer, and
to complete the work within Ninety ( 90 ) talaXiWIK
days. If the Party of The±irst Part shall fail to complete the w—'rk iin the time
herein specified, he shall pay to the Party of The Second lrrt, as liquidated
damages, ascertained and agreed, and not in the nature of a penalty, the sum of
Thirty & No/100 (11 30.00 ) f^r each day delayed,
which shall be deducted from the final ar ,unt estimate made by the contractor.

SECTION 3. There is hereby authorized and approved the
expenditure of the sum of Ninety Five Thousand Seven Hundred
Eighty Two and 03/100 Dollars ($ 95 ,782.03 ) from the
Street Construction Fund, Project 7, payable to A. P. T.
Construction Company according to the terms of the contract
set out in Section 2 hereof, which sum has previously been
appropriated for such purposes.
SECTION 4. The City Manager and Director of Finance are
hereby authorized and directed to execute the necessary warrants
in payment of moneys approved in Section 3 herein.
SECTION 5. This resolution shall be in full force and
effect from and after its adoption.
