4 RESOLUTION NO. 2.521; A RESOLUTION ACCEPTING THE LOW BID OF HARLEY UPTON IN THE AMOUNT OF TWENTY ONE THOUSAND, ONE HUNDRED FIFTY SEVEN AND 61/100 DOLLARS ($21, 157 .61) FOR THE CONSTRUCTION OF RECREATIONAL AND REST ROOM FACILITIES AT MACARTHUR, BOYLE AND ALLSOPP PARKS; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO AND EXECUTE AN AGREEMENT ON BEHALF OF THE CITY OF LITTLE ROCK WITH THE SAID HARLEY UPTON FOR THE SAID CONSTRUCTION; PROVIDING FOR PAYMENT OF SAID MONEYS; AND FOR OTHER PURPOSES . WHEREAS , invitation for bids for the construction of Recreational and Rest Room Facilities at MacArthur, Boyle and Allsopp Parks have been legally published; and WHEREAS , bids have been received and opened pursuant to said ad- vertisement; and WHEREAS , the bid of Harley Upton is the lowest bid submitted there- for; and WHEREAS , the City of Little Rock desires to award the contract for the said construction to said Harley Upton; and WHEREAS , the City has previously appropriated certain sums of money from the 1958 Bond Construction Funds for these projects; and WHEREAS , the Board of Directors of the City of Little Rock de- sires to authorize the expenditure of Twenty One Thousand One Hundred Fifty Seven and 61/100 Dollars ($21, 157 .61) from the Park & Airport Construction Fund previously appropriated; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The low bid of Harley Upton in the amount of Twenty One Thousand One Hundred Fifty Seven and 61/100 Dollars ($21,157 .61) for the construction of Recreational & Restroom facilities at MacArthur, Boyle & Allsopp Parks is hereby accepted. SECTION 2. THIS AGREEMENT made the Eighteenth day of _ _Aprils in the year Nineteen Hundred and Sixty by and between HARLEY UTQN hereinafter called the Contractor, and CITY OF LITTLE ROCK, ARKANSAS hereinafter called the Owner, WITNESSETH, that the Contractor and the Owner for the considerations hereinafter named agree as follows: ARTICLE 1. TIME OF COMPLETION The work to be performed under this Contract shall be commenced April 25 , 1960 and shall be substantially completed June 25 , 1960 (Here insert stipulation as to liquidated damages, if any.) ARTICLE 3. THE CONTRACT SUM The Owner shall pay the Contractor for the performance of the Contract, subject to additions and deduc- tions provided therein, in current funds as follows: Twenty One Thousand One Hundred (State here the lump sum amount, unit prices, or both, as desired in individual cams.)
