HomeMy WebLinkAbout2514 RESOLUTION NO. 251LL A RESOLUTION GRANTING ARKANSAS ALLRIGHT PARKING COMPANY, A PARTNER- SHIP, OR ITS ASSIGNS , THE PRIVILEGE TO USE CERTAIN EXCAVATED SPACE BENEATH THE SIDEWALK SURROUNDING THE EAST TWO-THIRDS OF BLOCK 86, ORIGINAL CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES . BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Arkansas Allright Parking Company, a partnership, or its assigns, is hereby granted the privilege to use certain excavated space under the sidewalk surrounding the East two-thirds of Block 86, Original City of Little Rock, Arkansas, for use in the operation of a subterranean parking area. The property to be used for such purposes is described as follows : Beginning at the Northeast corner of said Block 86 and running thence South 7 degrees West a distance of 300 feet to the South- east corner of said Block; run thence North 83 degrees West along South line of said Block 86 a distance of 188.4 feet to a point ; run thence South 7 degrees West a distance of 12 .4 feet to a point; run thence South 83 degrees East and parallel to the South line of said Block 86 a distance of 200.8 feet to a point; run thence North 7 degrees East and parallel to the East line of said Block 86 a distance of 324.8 feet to a point; run thence North 83 degrees West and parallel to the North line of said Block 86 a distance of 200 .8 feet to a point ; run thence South 7 degrees West a distance of 12 .4 feet to a point, on the North line of said Block 86; run thence South 83 degrees East along the North line of said Block 86 a dis- tance of 188 .4 feet to the point of beginning; containing 8699 .4 square feet, more or less . SECTION 2. The lateral and overhead supports of the excavated space under the sidewalk described above shall be constructed according to the provisions of Ordinance No . 7888 , commonly known as the Building Code, and subject to the inspection and approval of the Director of Public Works. SECTION 3. Arkansas Allright Parking Company, a partnership , as a condition upon this grant and privilege, shall assume primary liability to the public for any damage sustained by the public resulting from the construction or use of the property above described. SECTION 4. The City of Little Rock retains the right to revoke this franchise at any time that the above described property is needed for public purposes and Arkansas Allright Parking Company, or its assigns, -2- shall be required to restore the above described property to its condi- tion prior to excavation and to fill said excavated space to such level as may be required by the City of Little Rock, and shall, further, be required to pay all costs attendant to the restoration and filling of the excavated space described above. SECTION 5 . This resolution shall be in full force and effect from and after its adoption . ADOPTED: April 4, 1960 ATTEST: APPROVED: City lerk May
