HomeMy WebLinkAbout2507 RESOLUTION NO 2507 A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO AND EXECUTE AN ESCROW AGREE- MENT WITH JAMES S .. SCOTT AND BETTY LOU SCOTT, HIS WIFE; AND FOR OTHER PURPOSES. WHEREAS, James S. Scott and Betty Lou Scott, nis wife, have executed a certain Dedication Deed in favor of the City of Little Rock, Arkansas, relating to property therein described, in connec- tion with the widening and paving of University Avenue; and WHEREAS, as a part of the consideration for said Dedication Deed, the City of Little Rock has agreed to construct, build and otherwise establish a bridge for vehicular traffic over a certain drainage ditch located on the East side of and parallel to Univer- sity Avenue near the intersection of University and 19th Street; and WHEREAS, the City of Little Rock desires to enter into an Escrow Agreement with the said James S. Scott and Betty Lou Scott, his wife, relative said construction; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The Mayor and City Clerk are hereby authorized and directed to enter into and execute an Escrow Agreement with James S . Scott and Betty Lou Scott, his wife, which Escrow Agreement shall be in form and words as follows: E S C R O W A G R E E M E N T KNOW ALL MEN BY THESE PRESENTS: THAT WE, James S .. Scott and Betty Lou Scott, his wife, and the City of Little ROCK, Arkansas, for and in consideration of the mutual benefits accruing to us under the terms of this Agreement and under the terms of a certain Dedication Deed exe- cuted by James S. Scott and Bette Lou Scott, his wife, in favor of the City of Little Rock, Arkansas, dated , do hereby covenant and agree as follows: James S. Scott and Betty Lou Scott, his wife, have execu- ted a certain Dedication Deed in favor of the City of Little Rock, Arkansas, relating to the following described property, to-wit: Beginning at a point that is ten ( 10) feet ivEast ( 2o) the West line of Lot Seven ( 7 ) Block Bateman' s Subdivision of Cherry and Cox Addition and South twenty-three ( 23 ) feet from the North line of said Lot Seven ( 7) ; thence North parallel to and ten ( 10 feet East of the West line of said Lot Seven ( 7 ) , twenty-three (23) feet to the North line of said Lot Seven (7) ; thence easterly along the North line of Lot Seven ( 7) , twenty and two-tennis ( 20.2) feet to a point; thence southwesterly along an arc of a twenty-five (25) foot radius curve left twenty-nine and two-tenths (29.2) feet osP oint of tangency; thenceWest five ( 5) feet to the point of beginning, As a part of the consideration for the above Dedication Deed in favor of the City of Little Rock, the City of Little Rock has agreed and hereby does agree to construct, build and otherwise establish a bridge for vehicular traffic over a certain drainage ditch located on the East side of and parallel to University Avenue near the intersection of University Avenue and 19th Street, Said bridge will be constructed during the calendar year 1960, and is to be adequate to permit the flow of traffic and the full use of 19th Street East of its intersection with University Avenue. It is hereby agreed by both parties hereto that said Dedi- cation Deed shall be placed in escrow and that Pauline Beeson, Clerk of the City of Little ROCK, shall serve as Escrow Agent to hold said Dedication Deed without filing same of record until such 2 — time as the conditions above described are complied with, and the drainage ditch above described nas been constructed by the City of Little RocK, Arkansas. Upon the satisfactory completion of the bridge, then, and only then, snail the City of Little Rock be entitled to file for record the Dedication Deed referred to herein, WITT ;SS our hands and seals to is day of , 1960, James S.
