HomeMy WebLinkAbout2469 RESOLUTION NO . 2469 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT TO PURCHASE AND TO SIGN A QUITCLAIM DEED REGARDING CERTAIN PROPERTY OWNED BY THE CITY NOW USED AS THE DOG POUND PROPERTY; AND FOR OTHER PURPOSES . WHEREAS, the City wishes to sell certain property described as Lots 11 through 20, Block 3 , and Lots 2 and 3 , Block 4, National Park Subdivision of the City of Little Rock, Arkansas, and Lots 1, 2, 3 and 4, Block o, Watkins Addition to the City of Little Rock and all property acquired by the City by virtue of closing certain streets abutting on the above properties; and WHEREAS, Raymond A. Karcher, Trustee, has agreed to purchase said property for the sum of Thirty-Five Thousand and No/1600 Dollars ($35 ,000 .00) , said offer being the highest bid therefor; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1 . The Mayor and City Clerk of the City of Little Rock shall enter into a certain Contract to Purchase with Raymond A. Karcher, which Contract to Purchase is set forth in Section 3 hereof. SECTION 2 . The Mayor and City Clerk of the City of Little Rock are and shall be authorized to sign a Quitclaim Deed conveying unto Raymond A. Karcher, Trustee, all of the property described in the Contract to Purchase, authorized in Section 1 hereof, upon the payment to the City of Little Rock of the sum of Thirty-Five Thousand and No/100 Dollars ($35 ,000 .00) cash, which Quitclaim Deed is set forth in Section 3 hereof. SECTION 3 . The Contract to Purchase, authorized in Section 1 hereof, and the Quitclaim Deed, authorized in Section 2 hereof, shall be in form and words as follows: ti CONTRACT TO PURCHASE (Date) 1. RAYMOND A. KARCHER, Trustee , herein called Purchaser, offers to purchase , subject to the terms set forth herein, the following described property: That part of Lots 11 through 20, Block 3 , lying South of and adjacent to a right of way reserved to the City of Little Rock, Arkansas, for an expressway, said lots being located in National Park Subdivision to the City of Little Rock, Pulaski County, Arkansas, and the North 25 feet of what was formerly Cast Twenty Eighth Street lying adjacent to the South boundary line of the above described lots; and the East 30 feet of what was formerly Geyer Street lying adjacent to the West boundary line of Lot 20 , Block 3 , National Park Subdivision to the City of Little Rock, Pulaski County, Arkansas; and Lots 2 and 3 , Block 4 , National Park Subdivision to the City of Little Rock, Pulaski County, Arkansas, and the North 25 feet of what was formerly East Twenty Eighth Street lying adjacent to the South boundary line of the above described lots; and Lots 1, 2, 3 and 4, Block 8, Watkins Addition to the City of Little Rock, Pulaski County, Arkansas, and the South 25 feet of what was formerly East Twenty Eighth Street, lying adjacent to the North boundary line of Lots 1 and 2, Block 8, Watkins Addition to the City of Little Rock, Pulaski County, Arkansas, and the East 30 feet of what was formerly Geyer Street, lying adjacent to Lots 2 and 3 , Block 8, Watkins Addition to the City of Little Rock, Pulaski County, Arkansas. 2. purchaser will pay $35 ,000.00 for said property. 3 . This offer is conditioned on Seller removing or having removed within 30 days after notice from Purchaser, without any expense to Purchaser, any or all improvements on the above de- scribed property before or after the consummation of this transaction. 4. Conveyance of this property shall be by Quitclaim Deed. 5 . Seller shall furnish at its own cost complete abstracts on the above described property. Said abstracts shall reflect title satisfactory to Purchaser' s attorney. If defects are found or objections are made to the title , the Seller shall have a reasonable time within which to correct the defects and meet the objections. If Seller is unable to correct defects in title , if any, to the satisfaction of Purchaser' s attorney, this Contract to Purchase shall be negated. 6. Possession of the premises shall be delivered within ten (10) days after closing. 7 . Karcher, Trustee , property in the City of Little Rock, hereinafter described: NOW THEREFORE, I , W. C. KNOOP, Mayor, and I , PAULINE G. BEESON, City Clerk of Little Rock, a municipal corporation , organized, chartered, and existing under authority of the laws of the State of Arkansas, for and in consideration of the sum of Thirty Five Thousand and No/100 Dollars ($35 ,000.00) cash in hand paid, the receipt of which is hereby acknowledged, acting for and in behalf of the City of Little Rock, Arkansas , do hereby convey, alien and quitclaim unto Raymond A.
