RESOLUTION NO. 2465
A RESOLUTION ACCEPTING THE LOW BID OF H. L. UPTON IN
THE AMOUNT OF FOUR THOUSAND SEVEN HUNDRED T' ENTY ONE
AND N0/100 DOLLARS ($4,721.00) FOR REPAIRING AND RE-
MODELING OF THE ELEPHANT AND MONKEY BUILDINGS AT THE
LITTLE ROCK MUNICIPAL ZOO; AUTHORIZING AND DIRECTING
THE MAYOR AND CITY CLERK TO ENTER INTO AND EXECUTE
AN AGRi.ji14ENT ON BEHALF OF THE CI'lTY OF LITTLE ROCK,
ARKANSAS, WITH THE SAID H. L. UPTON FOR THE SAID PRO-
JECT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND
DIRECTOR OF FINANCE TO EXECUTE THE NECESSARY WARRANTS
THEREFOR; AND FOR OTHER PURPOSES.
WHEREAS, invitation for bids for repairing and remodeling of
the Elephant and Monkey Buildings at the Little Rock Municipal
Zoo have been legally published; and
WHEREAS, bids have been received and opened pursuant to said
advertisement; and
WHREAS, the bid of H. L. Upton is the lowest bid submitted
therefor; and
WHEREAS, the City of Little Rock desires to award the contract
for the said project to the said H. L. Upton;
NOW THEREFORE, BE I`1' HESu ,VED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The low bid of H. L. Upton in the amount of Four
Thousand Seven Hundred Twenty One and No/100 Dollars (4, 721.00) for
• repairing and remodeling of the Elephant and Monkey Buildings at
the Little Rock Municipal Zoo is hereby accepted.
SECTION 2. The Mayor and City Clerk are hereby authorized and
directed to enter into and execute on behalf of the City of Little
Rock an Agreement with H. L. Upton for the said project, which
Agreement shall be in form and words as follows:

ARKANSAS, acting by and through its Mayor and City Clerk, pur-
suant to the provisions o Resolution No, , hereinafter
called "First Party" and ii. L. UPTON, hereinafter called "Second
Party,"

Tilt for and in consideration of the promises and covenants
hereinafter contained the parties hereto mutually agree as follows:
10 Second Party agrees to furniti, all tools, labor, equipment
and materials for repairing and remodeling of the Elephant and
:'onkey buildings at the Little Rock Municipal Zoo in exact accord-
ance with the plans and specifications on file in the Office of
the Director of Public Works of tale City of Little Rock, Arkansas.
A copy of the plans, rpecifica Lions, and old proposal for the said
project is attached hereto and made a part ereof as though copied
in full herein. i'ne sa 'u project shall be under the direct super-
vision of the Director of Public ' orks of the City of Little Rock
and shall be completed to his ea till -:c tion in a:: ordance with said
plans and specifications. Said project shall to subject to In-
.spection at all times.

within ninety (9u) calendar days from the date of commencement.
In the event that the Second Party fails to complete the said
work in the specified time, the second Party shall pay First
Party as liquidated d'.-;x1t,es ascertained and agreed, and not in
the nature of a penalty, the sum of Twenty Five and No/100 Dol-
lars (42j.00) per ,Jay- for each day that, the completion of the
said project e--ceeds the above specified times
4, Tnat the work and material for the said project shall be
completely installed and delivered by the Second Party to the
First Party within the time above stated, clear and free from any
and all liens, claims ar.a demands of any kind, for materials,

insure prompt, faithful, sufficient and complete performance of

SECTION 3.. The City Manager and Director of Finance are
hereby authorized and directed to execute the necessary warrants
in payment of the bid price herein.
SECTION 14.. The bid price accepted in section 1 hereof shall
be paid from the Parks and Airport Construction Fund, Project id,
which appropriation exists by virtue of Ordinance No. 10,921.
SECTION 5. This resolution shall be in full force and effect
from and lifter i .s adoption.
