3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK. CODE 18- 3(b)(3)
4 TO INCREASE THE SERVICE CHARGE FOR BAD CHECKS TO $25.00
5 AS AUTHORIZED BY STATE LAW; AND FOR OTHER PURPOSES.

7 WHEREAS, the City collects a service charge for bad checks uttered to the City
8 to offset the cost of collection; and
9 WHEREAS, the Legislature has increased the service charge maximum from
10 $20.00 to $25.00 in Ark. Code Ann. §5 -37 -304; and
11 WHEREAS, it is desirable to increase the City service charge to further offset
12 collection costs.
13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
14 OF THE CITY OF LITTLE ROCK, ARKANSAS:
15 Section 1. Little Rock, Ark. Code §8 -3 (b)(3) (Rev. 1988) is hereby amended to
16 read as follows:
17 (3) Payment was refused by the drawee for lack of funds, upon
18 presentation within thirty (30) days after delivery, and the maker or
19 drawer shall not have paid the city the amount due, together with a
20 service charge not to exceed twenty -five dollars ($25.00), within ten (10)
21 days after receiving written notice that payment was refused upon the
22 check, draft, or order. Nothing in this section shall impair the city
23 attorney's power to immediately file charges after the check has been
24 returned prior to the sending of the notice as described in this section.

1 Section 2. Repealer. All ordinances, resolutions, or regulations, or any parts of
2 such documents, which are inconsistent with the provisions of this ordinance are
3 hereby repealed to the extent of such inconsistency.
