A RESOLUTION GRANTING PERMISSION TO ROWLEY UNITED
THEATRES, INC. , TO ALLOW FENCES ERECTED ON THE
NORTHWEST CORNER OF 21st STREET AND BARBER AVENUE
TO REMAIN AT THEIR PRESENT HEIGHT AND LOCATION
UPON A TEMPORARY BASIS , PROVIDING THAT IF IT IS
NECESSARY THAT THEY BE MOVED SUCH REMOVAL SHALL
TAKE PLACE AT THE EXPENSE OF ROWLEY UNITED
THEATRES, INC .
WHEREAS , the City of Little Rock, acting upon the
recommendation of its Cemetery Board, leased the property owned
by the City on t-ie Northwest corner of 21st Street and Barber
Avenue in the City of Little Rock, to Rowley United Theatres,
Inc . , for the purpose of erecting a Drive-in Theatre, and
WHEREAS, said theatre has beenerected, and upon
completion of the tower holding the projection screen, it was
found that automobile lights travelling East on 21st Street and
South on Barber Avenue reflected upon said screen, making it
necessary that a high protective fence be erected along the
property lines to shield the said screen from said lights, said
fences in some places exceeding nine feet in height, and
WHEREAS, upon the erection of said two fences, through
error and inadvertence upon the part of the manager and con-
tractor, said fences have been constructed partially upon the
side-walk area of the boundary streets, and
WHEREAS, said fences are constructed of concrete and
sheet aluminum at an exceedingly heavy expense to the Theatre
Company, and
WHEREAS, ample side-walk space for pedestrians still
exists and no practical harm is resulting from the fences in
their location at present, and
WHEREAS, said Company has requested that the fences
be permitted to remain where they are now erected and at their
present height until such a time as the City of Little Rock
deems it necessary to request their removal;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LITTLE ROCK, ARKANSAS :
That permission is hereby granted to the Rowley United

Theatres , Inc . , to allow said fences to remain in their present
location and present height upon the temporary basis and until
such time as it is deemed essential by the City of Little Rock
that said fences be moved back and off of the portion of the
side-walk area now being occupied, at the expense of Rowley
United Theatres, Inc.
