HomeMy WebLinkAbout1920 RESOLUTION NO. 1920 A RESOLUTION AUTHORIZING THE CITY ATTORNEY OF THE CITY OF LITTLE ROCK TO BRING CONDEMNATION PROCEEDINGS AGAINST LAND OWNED BY THE CHICAGO, ROCK ISLAND AND PACIFIC RAIL- ROAD C OMPANY FOR THE PURPOSE OF ACQUIRING SAID PROPERTY FOR THE USE AND BENEFIT OF THE LITTLE RUCK MUNICIPAL AIRPORT, DESCRIBING SAID LAND, AND FOR OTHER PURPOSES. WHEREAS certain land is owned by the Chicago, Rock Island and Pacific Railroad Company; and WHEREAS said land is necessary for the use and benefit of the Little Rock Municipal Airport : and WHEREAS said Chicago, Rock Island and Pacific Railroad Company refuses to sell said land to the Little Rock Municipal Airport; and WHEREAS, for the purpose of acquiring said land, it is necessary that the City exercise its power of eminent domain: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the City Attorney be authorized and directed to proceed under the City's power of eminent domain to condemn, for the purpose of acquisition by the Little Rock Municipal Airport Commission, a sub-division under the government of the City of Little Rock, certain lands now owned by the Chicago, Rock Island and Pacific Railroad Company, which said railroad company refuses to sell to the Little Rock Municipal Airport Commission, and which is more particularly described as follows, to-wit: Beginning at the Northwest corner of the Northeast Quarter (NE4) of Section Thirteen ( 13 ) , Township One ( 1) North, Range Twelve (12) West in Pulaski County, Arkansas ; thence South along the One-Half (2) Section line of said Section, a distance of five hundred and seventeen feet ( 517' ) to a point on the South right-of-way line of East Twenty- Sixth Street; thence East along said right-of-way line, a distance of thirteen hundred forty-seven and five-tenths feet ( 1347.5' ) to a point of beginning; thence to the right at an angle of thirty-seven degrees and fifty-two minutes (37° 52 ' ) a distance of one hundred eighty-nine and fifty-one hundredths feet ( 169.51' ) to a point; thence to the right at an angle of ninety-seven degrees and eighteen minutes (97° 18' ) , a distance of one thousand fifty feet (1050' ) to a point; thence at an angle of three hundred and twenty-six degrees and thirty-seven minutes (326° 37 '4 to the left a distance of four hundred fifty-four and twenty-six hundredths feet (451.4 .26' ) to a point; thence at an angle of eleven degrees and forty-one minutes ( 11° 41' ) to the right, a distance of one thousand ten and two-tenths feet ( 1010.2' ) to a point on the West right-of-way line of the Missouri Pacific Railroad; thence at an angle of one hundred nineteen degrees and twenty-four minutes ( 119° 24' ) to the left a distance of eight hundred eighty-two and five-tenths feet (882.5' ) along the said West right-of-way line to a point which is common to said right-of-way line and the South right-of-way line of East Twenty-Sixth. Street; thence at an angle of sixty degrees and fifty -2- minutes ( 600 50' ) to the left a distance of four hundred thirty and seventy-five hundredths feet (430. 75' ) along the South right- of-way line of Last Twenty-Sixth Street to the point of beginning, said parcel containing fourteen and three hundred and four thousandths (14.304) acres, more or less . SECTION 2. That the expense and cost of such condemna- tion of the apove-described land, together with the cost of acquisi- tion of said land, in accordance with the judgment found in the condemnation suit, shall be paid for from the funds controlled by the Little Rock Municipal Airport and, upon the completion of said condemnation, said land shall be held and controlled by the Little Rock Municipal Airport Commission for the use and benefit of the Little Rock Municipal Airport.
