A RESOLUTION PLEDGING COOPERATION WIT1 THE ARKANSAS-LOUISIANA GAS
COMPANY IN LAYING, REPAIRING OR RELOCATING PIPELT.N ES I 'i A CERTAIN
AREA OF LAND RECENTLY ACQUIRED FO?=MMICIPAL AIRPORT PURPOSES; AND
ti FOR OTHER PURPOSES.
WHEREAS, the Little Rock Municipal Airport Commission is
now engaged in extending one of the runways of the Little Rock Municipal
Airport in a northeasterly direction in close proximity to a certain
parcel of land formerly owned by Douglas G. Brown and recently acquired
by the Little Rock Municipal Airport Commission subject, however, to an
outstanding easement and right of way grant made by the said Douglas G.
Brown to said Arkansas Louisiana Gas Company prior to the acquisition of
said land by the said Little Rock Municipal Airport Commission, and
WHEREAS, the Little Rock Municipal Airport Commission has
found it necessary in connection with such proposed extension of runway
to request Arkansas Louisiana Gas Company to waive certain rights now
held by said Arkansas Louisiana Gas Company in and to said easement and
right of way, and Arkansas Louisiana Gas Company has agreed to execute a
written Agreement waiving such rights on condition that the City of Little
Rock agrees that if and when the aforesaid lands are incorporated within
the City limits of the City of Little Rock and the Arkansas Louisiana Gas
Company at any time thereafter finds it necessary to alter, repair, re-
locate or remove the present existing pipeline located upon said lands,
or finds it necessary to lay any additional pipeline or pipelines across
said lands, or alter, repair, relocate or remove the latter the City of
Little Rock, upon request of Arkansas Louisiana Gas Company, will temporarily
close to traffic East 9th Street as extended across said lands as well as
any other street or roadway that may also at that time cross the same during
the time that such work is in progress, and
WHEREAS, Arkansas Louisiana Gas Company has voluntarily
waived certain rights held by it in said lands without payment of any
consideration whatsoever and solely for the purpose of enabling the Little
Rock Municipal Airport Commission to carry out the proposed extension and
improvement of the Little Rock Municipal Airport and its facilities, and
because the request made by Arkansas Louisiana Gas Company is reasonable
and for its best interest and the best interest of the public in the event
future work becomes necessary upon its existing pipeline now located upon
said lands or such work becomes necessary upon additional pipelines here-
after located by it thereon, NOW, THEREFORE,
BE IT RESOLVED by the City Council of the City of
Little Rock in regular meeting assembled, that if
and when the following described lands, toit:
Being that certain tract or parcel of land located
in Sections 5, 6 and 8, Township 1 North, Range 11
West, a portion of that certain 21.2 acre tract con-
veyed by W. D. Cammack to Douglas G. Brown February
6, 1945, and recorded in Volume 312, Page 188, Deed
Records, Pulaski County, Arkansas, and more particu-
larly described as follows: From the common corner
of Sections 5, 6, 7 and 8, North 89° 57' West 416.1
feet; thence North 8° 27' East 30.3 feet to place of
beginning on the north right of way line of East 10th
Street; thence North 8° 27' East 505.4 feet to a point
in north right of way line of East 9th Street; thence
south 83° 23?' East with the north right of way line of
East 9th Street 178.21 feet to an angle point in said
North right of way line; thence south 59° 52' East,
crossing East 9th Street, 125.27 feet to a point in
South right of way line of said East 9th street; thence
South 59° 52' East 1059.71 feet to a point in West right
of way line of East 9th Street; thence continuing south
59° 52' East 18.0 feet to a point near center of East
9th Street; thence south 56° 18' West 42.0 feet to point
in West right of way line of East 9th Street; thence -
South 56° 18' West 145.27 feet to point in North right
of way line of East 10th Street; thence with North right
of way line of East 10th Street in a northwesterly and
westerly direction to place of beginning, containing
7.8 acres, more or less; are incorporated within the
City of Little Rock, and thereafter Arkansas Louisiana
Gas Company finds it necessary to alter, repair, re-
locate or remove its present existing pipeline located
upon said lands or finds it necessary to lay any
additional pipeline or pipelines across said lands, or
alter, repair, relocate or remove any of said pipelines
the City of Little Rock, upon reasonable prior notice
and request of the Arkansas Louisiana Gas Company will
temporarily close to traffic East 9th Street as extended
across said lands, and any and all other streets or
roadways that may at that time cross the same, during
the time that such work is in progress.
BE IT FURTHER RESOLVED, that the City Clerk forward to
Arkansas Louisiana Gas Company, a certified copy of this
Resolution,
