HomeMy WebLinkAbout1842 RESOLUTION NO. 1842 A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO OFFER TO SETTLE WITH THE UNITED STATES OF AMERICA FOR THE SUM OF $150,000.00 THE NON-PHYSICAT DAMAGE CLAIM OF THE CITY NOW PENDING; AUTHORIZING OTHER CITY OFFICIALS TO EXECUTE SUCH INSTRUMENTS AS MAY BE NECESSARY IN CONNECTION THEREWITH; AND FOR OTHER PURPOSES. IMMODOXIDOEUXXXXXXXX WHEREAS, The City of Little Rock, through its City Attorney, has filed a claim against the United States Government for physical and non-physical damages to its airport which occurred during the occupancy of the airport by the United States Government during the recent emergency, and WHEREAS, The Congress of the United States has , upon recommen- dation of the Civil Aeronautics Administration appropriated 5187,000 to compensate the City of Little Rock for its physical damages to the airport, and WHEREAS, The City has been negotiating with the United States Department of Justice officials in Little Rock and Washington, D. C. for a settlement of the claim of the City for non-physical damages, rent, and other compensation during said occupancy, and WHEREAS, Certain officials of the Department of Justice have indicated that they will recommend to the Attorney General that an offer on behalf of the City to settle this non-physical damage claim for the sum of 450,000 be accepted by the Government, and WHEREAS, It being the opinion of the City Attorney and the Con- sulting Engineer upon this project that 0150,000 would be a fair and just compensation for this non-physical damage claim, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LIT_LE ROCK, ARK: SECTION 1. That the City Attorney be and he is hereby author- ized and empowered to offer to settle with the United States of America for the sum of $150,000 the non-physical damage claim of the City of Little Rock now pending in the United States Court of Claims, the same being No. 48765 and styled, The City of Little Rocks Arkan- sas vs The United States of America. SECTION 2. The City Attorney and any other city official the United States of America may deem necessary are further authorized and empowered to execute such instruments and perform such functions as may be necessary to bring about the settlement of said claim up- on the basis hereinbefore set forth, and bring said litigation to an end.
